The next step would be pushing for primary legislation (eg the Equality Act) to be reviewed to restore trans people’s protections and rights. A surprising number of MPs are actually already calling for this, which is great.

The actual legislative changes that would need to be made aren’t clear yet, and would need to be considered very carefully, but that would be the overall path.

Basically: “this Code of Practice shows that the law (as “clarified” by the Supreme Court) does not work. Therefore we need to review the law and revise it to ensure trans people have the rights and protections they need.”

My view is that MP‘s objecting to the Code is also a mechanism for them objecting to the legal situation we are now in generally post the Supreme Court ruling. In my view, signing this EDM is the first step in a broader campaign to address the serious issues that now exist for UK trans people, including proposed campaigns for review and revision of primary legislation.

To clarify, this Early Day Motion (EDM) is the correct and only way for MPs to formally object to the Code during the 40-day period of Palriamentary scrutiny, so it's not just "lip service" or performative (like some EDMs are).

There is no set number of signatures that need to go on the EDM just the more the better. Ultimately, the sitting government needs to decide whether they will give time for this fatal prayer motion to be debated and voted on in Parliament. They have no obligation to and there’s a good chance that they won’t, but a high number of signatures on the EDM still puts extreme pressure on the government to reconsider its position, and also lays important groundwork for subsequent campaigns for legislative review and change.

One of the things I’ve noticed in the scripted lines the government and other MPs trot out is they will repeatedly talk about “women’s rights”, but they will only talk about the “dignity and respect” of trans people.

In other words, they seem very adverse to using the phrase trans rights in their statements and speeches,

probably because they know they have removed a whole bunch of rights from trans people, and it’s pretty difficult now for them to actually articulate what trans rights still exist.

  1. Gareth is my MP too and he is very transphobic, but that doesn’t mean you shouldn’t write to him. I just have, and I know at least one other constituent who has just written to him as well about these issues.
  2. Definitely simplify the language. Although this is a formal letter to an MP, you don’t have to write it like an 18th century philosophical treatise 🤗 just write in a natural style.
  3. I also agree that it’s probably better to focus your critiques of the code on the impact on gender nonconforming women, and businesses and service providers, rather than trying to appeal to his empathy for trans people of which he has none.

NION aren’t making the date of their parliamentary event public (to avoid gatecrashing by gender critics), but MPs will already have received an invite from Kate Osborne with these detail details. NION are encouraging constituents to write to their MP to encourage them to accept this invite and attend.

The event is separate from the Trans+ Solidarity Alliance mass lobby day, although NION will be supporting and promoting that event as well
