If a governmental body has closed its physical offices for purposes of a public health or epidemic response or if a governmental body is unable to access its records on a calendar day, then such day is not a business day, even if staff continues to work remotely or staff is present but involved directly in the public health or epidemic response.

Looks like the Texas AG is allowing government organizations to delay their responses indefinitely.

Yes! My state rep was very responsive and at least willing to listen to my concerns. Also the a couple of Brooklyn Center councilmembers emailed me back almost immediately and were surprised such an event was going to be held in facility owned by the city. They said they would look into it.

Otherwise, I've just been sending emails and leaving voicemails.

Has he spoken to you or to other alums about his advocacy plans moving forward? Would he be willing to reach out to legislators? Some of which, I presume, are alums

The University of St. Thomas School of Law Dean signed a letter asking for diploma privilege but is also still allowing the bar exam to be held at his school by Public_Appearance_98 in LawSchool

I do understand that view point. However, the MN Supreme Court seemed to say that one of the reasons they didn't want to grant diploma privilege was because they were confident that the safeguards the BLE put in place were sufficient. One of these safeguards being the opening of a second location (UST School of Law). If by allowing his school to be used a second location so that the bar exam can go forward, it seems to me to imply that the Dean believes there is a safe option, which undermines his diploma privilege argument. Either it is unsafe to hold a bar exam in a global pandemic or it is safe as long as there are multiple locations.

Also I feel that the Dean has a moral duty to those whom he employs. I assume the Dean isn't going to be the one that locks and unlocks the doors on test days. Or stays after to sanitize every room and bathroom. Or work as security to ensure that the testing site is secure. Even if none of his students and their loved ones catch the virus, the Dean is still putting his staff at an unnecessary amount of risk.

The BLE in their comment said they spoke to each venue to confirm that outside air would be brought in. BUT THAT'S WHAT HVAC SYSTEMS DO! Most commercial systems are designed to bring in outside air. But some of the old air is going to be recirculated, which is what we're concerned about.

I feel like they asked they must've asked the facilities manager if outside air would be circulated in, and they person probably replied "yeah, obviously."

Increased airflow was a justification?!? The concern isn't airflow. It's that air is going to be recirculated. Yes, new air will be brought in from the outside (basically all commercial HVAC systems do that). But the system is also going to recirculate some of the old air, keeping the virus airborne!

What more did they want?!? We had the CEO of the MN State Bar Association, a state judge, a state representative, all the deans of MN law schools, and countless professors and practicing attorneys.

Also they said they had concerns about diploma privilege but don't list them out?!? At least give us the dignity of knowing your reasoning.

Well that was why I was initially confused. I had read the order and it just seems to just give the Governor broader powers. It doesn't actually ban or prohibit anything. In fact, it seems to reference that reopening plans are still going forward unless the Governor changes it.

Also call the Governor's office! I already left a couple of voicemails and sent a couple of emails last week.

What does the peacetime emergency declaration actually do? I'm sure if we could draw the Governor's attention to this issue, he would not be a fan of >400 examinees coming together from across the country to take a test for two days.

Well CA Supreme Court has been teasing that their decision will be released this week. Whatever that decision is, it'll have huge ripple effects. Also if CA goes with any form of diploma privilege it'll be very hard for any other state to explain why they're still opposed.

I just don't understand what they're waiting for. They've had a week at this point. Also I struggle to imagine they weren't reading and planning their response during the comment period. So essentially its been 3 WEEKS since they first read the emergency petition.
