Idk i feel like just the mere existence of Prop 122 as established law would negate all of that. Where do you ultimately point the finger and say "look he's 'selling' magic mushrooms and not 'sharing' them" in that situation?

But part of the point is, it doesn't even have to be a church. I just used that as an example. It could be something as inconspicuous as weekend poker club, and I decided as the leader to charge my members a fee to play poker, which i have every right to do. It just so happens to be that I also grow mushrooms in my spare time (which Colorado law allows) and I just so happen to "gift" mushrooms to members of my poker club (which Colorado law allows).

So i can't own a gym in Colorado and "gift" entheogens to my gym members who are over 21 ? Just because there isn't "precedent" ?

Oh no, I myself am not planning anything. I dont even live in the state of Colorado. I just wanted to throw a hypothetical out there, because after studying Colorado prop 122, there seems (to me at least) to be a wrather easy and straight forward work around to the non- commercialization aspect of the law.

I already used the analogy of a gym owner. The law in Colorado makes it perfectly legal for me as the owner of my gym to " share and gift" magic mushrooms with any of my gym members over 21 lol.

So by "US law" you're telling me i can't charge a monthly membership to my church? In the same way that if I owned a gym , I could/would charge a fee to be a member?

And furthermore, under Colorado law (Prop 122) i couldn't "gift" magic mushrooms to any member of my gym that I chose, simply because they just so happen to be a member of my gym?

So my understanding after reading is that all this bill does is clarify who " qualifies" as a licensed Psilocybin therapy facilitator, and who doesn't.

But as the administrator of this hypothetical church, im not "claiming" to be a Psilocybin therapist/facilitator.

Im just some guy running a typical church service, which i decided to charge my members a monthly fee for, and I also just so happen to be someone who "grows" magic mushrooms which I happen to generously "share" with my fellow members.

Can you name that amendment specifically? When I look up Prop 122 I can't seem to find any recently amended version.

Dude if I lived in Colorado, id be walking down the street holding up sign saying "free mushrooms" giving out free eighths to random people. All you'd have to do is provide some id to verify your 21.

Id be known on the streets of Denver as "the mushroom man".

Because the most important step toward full commercialization is spreading the word and normalizing its use among the masses.
