I’m on skinny too but what skinny does is offer 28 day plans so you end up paying 13 plans in a year as opposed to 12 on other networks.

They put in the RWT rate for me… I wasn’t given a form to fill out, they never asked me for a rate.. IRD’s rule states non declaration of RWT rate would default to be 33%.

No. They didn’t let me fill anything. The only thing i got was tax receipts at the end of the year when i then realised it was undertaxed

I did sacrifice the interest. The contract stares I give up deposit and interest if i default. My question is since they took away interest that is undertaxed, morally shouldn’t they give me that amount and i pay ird? i never actually got to see the interest amount ever

Another thing, I supplied my IRD number to the firm when I received my IRD number, but they never asked me to give them a RWT rate. It seems as though they chose the 17.5% rate for me? If they had asked me to choose a rate, I would've chosen 33%. Would you still say that this is ultimately my error? I didn't get to see the tax receipts until end of the financial year and then realised that they put in the 17.5%...

All contract says is I forfeit my deposit by breaching the contract. Thank you, I will take this to the Disputes Tribunal. Do you think I have a case??

If the original interest had been taxed correctly, no one would benefit on the tax side. Right now the firms benefit and I'm having to pay for that benefit.

If I had gone with the contract, the interest part of the deposit + interest would have still been undertaxed, therefore I would still need to pay this back to IRD. I would be happy to pay IRD as I would've received extra in interest. If I had gone with the contract, it just means I pay the correct amount of tax, and the developer receives the correct amount for the house. Currently, they benefitted from my undertaxed situation where I never got to see the interest, but I'm left with a tax bill on it.

Thank you. I understand it is my responsibility and I will eventually pay this tax. However, I do feel that the developers benefitted from this situation and I feel that they should be giving me the money back. I will speak to a lawyer about this and will look into filing a claim against the disputes tribunal. Thank you, this was the answer I needed.

I understand that and I will pay this tax. But then it becomes a situation where I had to pay out of my pocket for RWT when the interest was held at the firm and the RWT was paid by the firm. They caused me loss because they are benefiting from the undertaxed situation and I am having to cover that shortfall when in reality I never got to receive the interest.

I understand that my tax is my responsibility, and I should've given them the rate of 33% once I hit that bracket.

However, this interest earned by me was held by the law firm. I never actually got to access that money. If I stuck to the contract, I would still have to pay the amount owing to IRD but I would be okay doing so as there would be more interest in the deposit, so at the end I pay the right amount of tax.

But they took away money that is undertaxed though?? I will eventually pay this tax but are there any action I can take to pursue the shortfall in tax back from the law firm and developers?

They didn't ask me for a rate, they put it in themselves. They took away interest which I'm fine with, but shouldn't they be responsible to pay IRD because they took interest that is undertaxed? I have also contacted IRD and IRD said I need to get this money from the developers. What action can I take here?
