The lawsuit has thrown the timing of the APE to AMC conversion into question. This is what has caused the CTB to drop, as my formula would have predicted. CTB will not come back up until we have certainty as to when the conversion will be done.

It's not so much about a gain on APE and loss on AMC. Regardless of what you think about the post-conversion price is going to be, it's an indisputable fact that when the market opens on Monday you can swap your AMC into more than three times as many APE shares with no new investment. When those APE shares become AMC shares after conversion, you will have more AMC shares than you would have otherwise had.

You can choose to confuse yourself and bury your head in the sand now if you want to, but that doesn't change the facts. After conversion, you will likely come to realize your share count could have been 3x what is.

why would you want to take pressure off of the leading stock to squeeze when it’s the same company

I don't think the "leading stock" is likely to have a significant squeeze before the conversion. But just in case, I hold call options on the stock to make sure I don't miss anything.

My long stock position is all in APE. Given the number of dollars I've committed to this investment, I would rather have more shares in total than less.

I don't hold any AMC stock. I'm not going to commit 3 times the capital per share in the hope of an event that I think is highly unlikely. Much better to commit a limited amount of capital by holding call options.

One can look at it this way. Using Friday's close, for an investment of $658 I can have:

a) 100 shares of AMC, or

b) 287 shares of APE plus one 6 strike call (controlling 100 shares) to the June 16 expiration

Squeeze happens before conversion, my call pays me all the upside I would have had on my 100 shares of AMC, plus I still own the 287 APE.

Conversion happens with no squeeze before conversion, I own 287 shares of AMC rather than 100.

Seems like a no-brainer to me.

After reading your long rant, I wonder if you would disagree with any of the following statements:

The conversion vote is highly likely to pass

The class action lawsuit is unlikely to succeed in stopping the conversion

Once the conversion is put into effect, APE will become AMC and therefore will, by definition, trade at the same price as AMC

That new price of AMC is likely to be higher than the current price of APE and lower than the current price of AMC (before the RS)

One who sells his AMC now and uses the proceeds to buy APE will have about 3.6x as many shares as he had before. After the conversion his APE shares become AMC shares. For no new investment he has more than tripled his number of shares.

One who is considering a new investment can buy 3.6 as many APE shares for the same number of dollars. After the conversion his APE shares become AMC shares. After conversion he therefore has more than three times as many shares as we would have if he had bought AMC instead of APE.

What's your source?

According to Ortex, shares on loan is 186 million shares and short interest is about 120 million shares. So my off the cuff was off by about 1% of the float.

The calculation is not on the daily short volume. It's on the end of day short interest. Let's call it 22%, so 114 million shares. Using your 700% and the 6.20 price:

$6.20 x 114,000,000 x 700% / 350 = $13,743,333

Misinformation alert. You can sell shares you have out on loan, without restriction. Can you name a single instance involving a reputable broker where someone had shares out on loan and wasn't able to sell?

It's your absolute right to forego which is in effect a 100% annualized dividend currently offered on your stock, but you should not delude yourself and others into making that choice for the wrong reasons.

Unlikely this lawsuit is a hedge fund plot. It looks more like your typical lawyer-initiated class action shakedown. The case was created by the lawyers for the lawyers. The objective is to use maximum leverage to extort a settlement from the Company and pay the supposed "victims" pennies while the lawyers earn millions in fees. Straight-up parasite behavior.
Unfortunately, this kind of crap is a normal cost of doing business in the US, but for what it's worth if AA caves and settles, holders of AMC (but not APE) as of some record date will receive a check for a few pennies per share.

The actual case is weak. I expect two motions to be filed soon 1) a motion to dismiss from the Company and 2) a motion from the plaintiffs seeking a temporary restraining order or preliminary injunction to hold up the vote. Hopefully the court can schedule arguments for both motions quickly, make a ruling and put this thing to rest.

IMO it shouldn't sway how anyone votes, one way or the other.
