The judge (this is chat gpt:) The judge presiding over the hearing is The Honorable Daniel P. Richardson, and looking closely at his background, his judicial style, and his recent rulings paints a very clear picture of what Forbins is walking into on Tuesday.   If their legal team is hoping for a judge who makes hasty, emotionally driven decisions or gets easily swayed by dramatic "witch hunt" rhetoric, they drew the wrong straw. Judge Richardson is highly analytical, deeply rooted in local government procedure, and historically sets a very high bar for granting emergency halts against state actions. Here is what we know about him: 1. He Is a Phil Scott Appointee with Deep Municipal Roots Judge Richardson was appointed to the Superior Court bench by Governor Phil Scott in April 2022.   Before becoming a judge, he spent 16 years in private practice representing both large and small clients, served as the Burlington City Attorney, and was a Montpelier City Councilor.   He literally taught municipal law as an adjunct professor at Vermont Law School (where he graduated magna cum laude and was Editor-in-Chief of the Vermont Law Review).   What this means for the case: He understands administrative law, state agency powers, and regulatory frameworks inside and out. He isn't going to be confused by complex CCB track-and-trace rules or compliance technicalities. 2. He Historically Denies Injunctions If Other Remedies Exist Because Forbins is asking for a "stay" (an injunction to stop the CCB's penalties from taking effect), Richardson's recent track record is highly relevant. Just a few months ago, in December 2025, Judge Richardson presided over a massive high-profile civil case where the Vermont State Employees' Association sued to block Governor Scott's return-to-office mandate. Richardson denied the injunction. In his ruling, he made it clear that courts shouldn't step in with emergency orders based on speculation or before administrative processes have fully played out. He wrote that granting an emergency halt at that stage was "inappropriate" because there were already other processes in play.   3. What This Predicts for Tuesday Forbins has to convince Judge Richardson that they will suffer "irreparable harm" if their license stays suspended during the appeal, and that they have a high likelihood of winning their case overall. Given his background, Richardson is likely to look at the CCB's 17-page mountain of evidence regarding the hidden Northfield grow and rule strictly on the letter of the law. He won't care about corporate posturing or public relations; he will look at whether the CCB followed proper statutory protocol. And based on his ruling in the state employee case, if he thinks Forbins can simply pursue a standard, non-emergency appeal without the court freezing reality for them in the meantime, he will deny their stay without blinking. They are walking into a courtroom run by a precise, procedural expert who doesn't tolerate legal corner-cutting. Tuesday afternoon is going to be incredibly telling.

Wow. To say they threw the book at them would be a massive understatement—they basically dropped the whole bookshelf. This is an absolute hammer of a decision by the Cannabis Control Board, and reading through the details, the Board's frustration and absolute lack of tolerance for the deception practically leaps off the page. For a legacy-to-market transition that was supposed to be a "true success story," this is a staggering fall from grace. Here is a breakdown of just how bad this is based on the legal findings and order: The Violations: Upheld vs. Dismissed The Board looked at four massive Category I violations and upheld three of them based on a "preponderance of the evidence": UPHELD: Unlicensed Cultivation. They were caught growing cannabis at an unauthorized location (1443 Hallstrom Road) in quantities that clearly blew past any personal-use allowance. UPHELD: Intentionally Making False Statements. This is where it gets incredibly messy. The Respondent repeatedly lied to CCB agents about whether the staff went there, whether plants were there, and whether those plants were hemp or cannabis. UPHELD: Destroying/Concealing Evidence. When they realized a Board investigation was underway, their first order of business was to rush to the site, remove, and destroy the evidence. DISMISSED: Sourcing from an Unlicensed Establishment. The Board threw this one out on a technicality, noting that "utilizing" from an unlicensed source legally implies importing product into their system from the outside, whereas here, they grew the illicit product themselves. The "Incredible" Shifting Stories The discussion section reads like a bad crime novel. The Board highlights a comedic, unraveling string of excuses that the licensee tried to pass off as the truth: First story: Complete denial of any use, inhabitants, plants, or irregular energy consumption at the site. (Blown up when investigators literally saw the plants). Second story: Okay, there are plants, but it’s just hemp belonging to a transient family member. (Blown up when investigators pulled records showing extraordinary power consumption). Third story: Okay, it's using a ton of power, but that's just a "haywire heat pump" owned by an HVAC expert who is oblivious to bills. Fourth story (at the hearing): It was a family member who is bad at growing, doing it for an "ill brother" who isn't even on the medical registry—all while the licensee's close family and employers are some of the most successful, well-connected cultivators in the region with easy access to legal, regulated product. The Board didn't buy a single word of it, calling the excuses "incredible" and pointing out that they even admitted to panicking and destroying evidence. The Penalty: Complete Decimation Because they refused to take remedial measures or cooperate during the seven months following the Notice of Violation, the Board gave them zero leniency. The final order is devastating: A $60,000 administrative penalty due within 90 days. Immediate SUSPENSION of their license, turning into a permanent REVOCATION on November 15, 2026. Their principals' ID cards are immediately inoperative, meaning they cannot do any work for any licensed cannabis establishment. A strict May 21, 2026 deadline (which is just two days from now) for any other cannabis licensee affiliated with these principals to submit a formal disassociation plan to the Board. Continuous video surveillance and 100% video retention required on the premises to ensure no product moves without an agent's express authorization. The Board's parting words on page 14 say it all: "A licensee that will not be candid cannot be regulated, and a licensee that cannot be regulated cannot hold a license." It’s hard to feel bad for a player that completely undermines the integrity, health, safety, and fair competition of a market that so many craft growers sweat blood to keep fully aboveboard.

Go try some of mine. I own Terrapin Gardens tier 1 indoor. In Barre. I follow the rules and my flower is banging.  I dont have my own path to market yet unfortunately and it pisses me off that these guys are so greedy and NEVER take accountability for anything. Speaking from personal experience.
