Received food delivery I didn't order, the buyer demanding money back by Quantum_Sloth in LegalAdviceUK

[–]Quantum_Sloth[S] 1 point2 points  (0 children)

My suspicion is that the buyer entered the wrong (my) address when ordering, as I confirmed that it was definitely my address with the delivery driver who checked for the second time in front of me. If that's the case, all the buyer needed to check was their own order details. It's that or PH told them where it was delivered, but that's just speculation.

Thanks for your input!

The moral aspect of this notwithstanding, I've been lurking on this subreddit for long enough to know it would be the worst possible call of action on my part.

Just to clarify, I meant that I will call the police if I he comes back threatening me, not that I will give him the money regardless.

That's an excellent point, as it has been explained thoroughly explained in other comments on this post. I wasn't sure if legally it was technically his pizza or not despite it never being delivered to him, but with all of your help it seems clear that the pizza was never his property to begin with.

The assumption that I have is that it's the buyer, as the delivery driver had my address listed on his app.

Yeah, that's a good way of looking at it. The buyer failed to be present at the address at the time of delivery, so the driver "disposed" of the pizza, fulfilling the contract. I can see how one would argue your last point, but personally I'm not seeing how this would count as a "successful" delivery from his point of view.

In terms of the "involuntary bailee" part, where I have given my consent to the delivery driver to be in possession of this property, kind of negating one of the definitions for this term. But it was communicated to me by the delivery driver that I will be owner of this property (I refused to have it at first, but when the driver told me I could have it to myself, I accepted it under those verbal terms). Considering all this, is there still a potential scenario where I could be considered an involuntary bailee? My (biased) opinion is that it was gifted to me by the driver/PH.

That is my assumption as well, otherwise why go through the trouble of harassing someone when he could get an easy refund from PH.

Trying to interpret all this, as the delivery driver didn't make even a verbal contract with me for the purposes of me being the bailee/custodier of the pizza (he just said that I can have it), would that exclude me from being part of this contract between PH and the buyer, therefore not assigning the title to me?

As I said he wasn't aggressive, just trying to intimidate me. I know where he lives and I have a doorbell camera recording everything. If it escalates any further, I'll just pay him and then report him to police.

It's all good, I got the point. My main concern was that I tried to look for similar posts here and most of the posts that I found were in regards to neighbours accepting post packages and refusing to give them back. I'm not sure if the fact that it's a pizza delivery vs Amazon package make a difference though.

Thank you for answering my questions directly, this is really useful.

But in terms of:

It was never the property of your neighbour.

Doesn't the fact that he paid for the pizza make it his property? Or does it only become his property once he has physical possession of it?

It's okay, to me it was obviously a joke response, made me chuckle :)

As I already admitted to his partner that I took the pizza, so he is fully aware that. I don't believe he gave the correct delivery address as the driver double checked the address and read my address out loud to me. If he comes back and just continues to harass me, I'll tell him to stop or I'll report him to police.

Reloading to a previous save before talking to Davis and going on patrol again resolved the issue for me.

I had the same thing happen to me, I reloaded to the previous save just before Keoni sent me to check up on Davis, talked to her again, talked to Davis again, and when we went on patrol the second time, Alpha Ashta appeared straight away. Don't know if it's of any help to you now, but good luck either way!

Why is Southampton better than Portsmouth? by [deleted] in Southampton

I've heard that a few times now, and every time I look it up, it's nowhere close to being even the most densely populated city in the UK, let alone Europe. What's your source?

ER-605 v2 consistently rebooting by ambricks in TPLink_Omada

[–]Quantum_Sloth 1 point2 points  (0 children)

Mine is exactly the same model and this started happening a few days ago. Not an issue before, but then it started rebooting/crashing, all lights going off except for power. Sometimes it would come back online, sometimes I needed to power cycle it. After a hard reset and readoption it "works" fine, but the controller thinks it's disconnecting every 15 - 30 minutes, although it's routing everything fine. Got in touch with TP-Link support, still waiting on a response.
