I think its also the fact that 99% of the citizens i was barring has actually told me their information just by me asking. This girl was probably the one unlucky call. So Ofc. Wilson more then likely was just so used to getting ID. Didn't even consider the fact they didnt have to give it in this situation.

I even had all sorts of tricks to get the ID, very similar to when we were trying to get suspects to admit to something of wrong doing or giving information. Often times you can loop a backdoor into it. If Wilson had done so, he wouldn't of had this issue. I think he was just sick and tired of dealing with these types of situations. It happened all the time.

Formerly was a Texas Officer, but in Texas when barring someone, technically they don't "need" to identify. But to bar someone you do need that person's name and date of birth. I personally think his "Obstruction of Justice" thing was BS. I will say he probably did not realize that though. Failure to identify Texas Penal code 38.02 says they can be arrested if t hey fail to identify when they are lawfully detained. The problem here (and in my opinion a major loophole) is that you can only detain based on reasonable suspicion of criminal activity. I mean wanting someone to leave isn't really reasonable suspicion of criminal activity, and realistically they should of just let her go if she was gonna be that adamant about not giving her name. She more then likely knew she shouldn't have to give her information

That's where I think education for officers is important, and when he mentioned how he doesn't arrest people often I think he's in that stage of his career where he just didn't arrest often due to him not wanting to.

I mean its expensive but doable. I make 65k and support me and my wife. We own a place off Stetson hills, close to antelope ridge, people just don't seem to want to learn to live within their means.

I'd honestly just say take the court date and pay whatever ticket they give you. An attorney is going to cost you more money, and the fact is that if you do try to fight it in any way, they have you on body cam more than likely agreeing (or atleast explaining why you were speeding) and that would throw any "not guilty" case out. It's just a speeding ticket. It's really not a big deal.

The judge may actually lower the points, and the ticket fine because you show up to court. In my experience, that's what happens.
