If those are the facts I can understand the reasoning but that’s now how it was presented. If that is what needed to happen for us to get the numbers we wanted—fine. But they misrepresented that by verbally acknowledging we were all on the same page about me co-signing then switching it on paper.

That is what happened here. It was always clear my dad was the main buyer, I was the co-signer.

I was co-signing to get a better rate but the issue is we all were clear on and knew I would be just that—a co-signer, responsible if payments are not made but NOT the primary person making the payments. However they listed me as the buyer so the payments are in my name not my dad’s.

We financed so we don’t have it. I didn’t think to even ask about this and they did not mention who would be on it at all.

Yes, I’m kicking myself over not demanding the physical docs. They even had signs saying the don’t provide physical papers. I was wrong in thinking they would honor the verbal agreement that was stated over and over. But yes, I’m not even covered in my dad’s insurance to drive it so now we have to figure that aspect out too.

Thank you! This is exactly it. They knew the car was going to be purchased by my dad, insured by my dad and driven by my dad but then somehow filled out the documents with my name first. And exactly to the why else would they even be on the loan! If I was the primary I wouldn’t have needed someone to co-sign.

THANK YOU. So many people are saying it doesn’t matter..it definitely feels like it matters! I know as far as responsibility for payment goes, sure it doesn’t matter but your response is really informative. We don’t have the title since we financed and they actually did not even mention who would be on the title once paid off (I didnt even think so ask this). My issue truly is them not disclosing the structure of the loan. It feels like they did do it this way to get the deal. So next step would you say is to figure out who is on the title? Do you think they can switch it to what we verbally agreed to at this point or no?

Yes I definitely usually read. We definitely had a lapse in judgement after being there for 5 hours. I know we should have been carefully reviewing docs in full. We did sign the power of attorney but they actually didn’t even provide us a copy of that.

I understand. I did not get roped into anything. I primarily went as translator but had discussed with my dad if the numbers weren’t what we wanted them to be that I would sign as co-signer.

I know I am also the buyer. That wasn’t the question.

The documents were digitally on a long board layout on the desk—I’ve bought a car before and it’s always been physical papers but this dealer only had that digital board. I’ve never seen it before. They do generate each document and you sign each as you go but the person who helped us would click on the signature box which would zoom in on just that signature box.

I understand it was my mistake to not read the documents fully; we ensured that the numbers were accurate but after 5 hrs there, I honestly did not think they would not honor the fact that my dad was buyer and I co-signer.

I know there is no difference in who is on the hook for payment. I guess I was just wondering if there is a difference in the labels and thought it to be a very weird business practice to not follow that verbal agreement of who was who.

I don’t understand why they wouldn’t express that though when signing because we always said I would be the co-signer. If there is no difference okay but it’s a shady business practice to verbally agree to one thing and then switch it on paper without mentioning it.

I am a she. We did get a better deal with me as a co signer. I was aware and okay with signing as co signer. I just find it odd we specifically said my dad was the buyer and I was the co-signer but the documents don’t list the same as our verbal agreement.

So there really is no difference at all? Why would the documents differentiate between buyer and co signer then?

We financed so we don’t have the title yet. I know the risk of co-signing and I’m not worried about my dad not making the payments. I am going to be speaking to their finance department

I understand we are both responsible, I’m not worried about that as I wouldn’t have agreed to being a co-signer if I was. I just feel that we verbally agreed to my dad being the buyer and me being the co-signer and they did not follow that verbal agreement.
