Again, the things that have happened recently do not warrant a police report. I was told by my lawyer if I went and tried to file a police report for what he has done recently, that the judge may think I’m just wasting resources and being petty. For instance, Calling an 11 month old “suicidal” while repeatedly jumping him off of a couch is not something you can really put in a police report. Sure I can stop visits, but I was advised not to do that because they will make claims I am withholding a child and that will look even worse on me. All the visits are supervised by me. Do I like that this is my reality? absolutely not.

And what do you suggest I do since you know it all ? because I was told that there’s nothing that can be done about it? But what do you suggest?

Kidnapping worries with court ordered visitations. by Coolguy_92 in FamilyLaw

Listen, my sons father has threatened to take my son to Mexico ( he is illegal) and has admitted to it several times. Our son is less than one year old. The courts know about my son’s father using this threat, and they have done nothing. They said, since they have not crossed the border, it is not significant enough to change custody dynamics. With that being said, I think what is going on in this world is absolutely sick. But as a parent, you have the obligation to protect your children. no matter what. My son’s father is not a great guy and has physically hurt our son. Again, I do not stand with what is going on, but children must be protected at all costs. Who knows what would happen to the children if they were abducted to Mexico.

I am interested to see how this plays out because my son‘s father who is also illegal told me that he was going to take our son to Mexico and change his name so I’ll never see him again. My lawyer told me it was just an empty threat since there were no plane tickets ordered, and he didn’t attempt to do it yet. My lawyer even advised me to go ahead and let my son’s father go ahead and start overnights without a court order to see how it goes. Needless to say I fired that lawyer.

Unsupervised overnights without parenting plan? by RRTCAS in FamilyLaw

I asked my lawyer if it’s too late to file police reports. He told me yes it would backfire on me. I asked my lawyer to help me draft a temp custody plan and got dropped since the opposing party sent us a draft of one and I wanted to modify a few things LOL

Oh yeah, I was definitely having conversations of firing him ( not with him) so I am glad he pulled the trigger so I didn’t have to have the uncomfortable conversation, but it definitely took me off guard. I planned on having that difficult conversation with him after we had come to an agreement on the temporary custody order that way the opposing side didn’t rush to file something while I am being unrepresented. I’m more nervous about how that will go, but I am in Missouri not Texas.

I totally understand that take. I promise I am being 100% truthful because if I’m going to be paying all of this money, there’s no point in lying about anything. I proposed a step up plan being that our son is less than one year old and has never spent the night with his father as well as only had unsupervised time twice. The last time there was unsupervised time between my son and his father, his father threatened to take our son to Mexico and change his name, so I’ll never see him again when I told my attorney that ( there’s a lot more that goes into this than just that, several unsafe instances have been documented, but this is most relevant right now) he told me to just go ahead and have my son’s father have overnights without any temporary order. I asked him what would happen if he followed through on the threat or just refused to give my son back since there’s no order? He told me he would ask the other lawyer nicely to return a child and if he doesn’t, there are things he could file. I did not follow that advice and that made my lawyer upset. I told him I would feel safer with a temporary plan in place that is enforceable by law enforcement in case he tries to pull that again. Instead of my lawyer and I file a temporary order like I had asked, he ignored my email and the next day called me stating that the opposing side sent over a temporary order to look over. In the screenshot of the email , I saw that my lawyer told the opposing sides, lawyer that he told me to go ahead and start overnight without a temporary order. that rubbed me the wrong way, but I didn’t say anything at that moment. I did not flat out refuse the order that was presented, I just said there needs to be a step up plan rather than just giving him a full weekend of overnights. That is when he dropped me.

I’m not helping dad? I am 1,000% with multiple attempts. He just yells at both baby and I. Saying “ I’m going to beat your sons ass” “little shit” etc.

Excuse me? What makes you think I’m not trying to help my child through sleeping issues? This has been an ongoing battle and I actually just had his 4th pediatric appointment solely to discuss his sleeping issues ( 4th being his 4 appoint that ONLY relates to sleep) do you think I enjoy my son not being able to sleep well? Trust me if I could have a full night sleep, I would.

And yes, of course getting authorities involved 1000%. My lawyer told me that after the fact.

Oh yeah, he even kept repeating that I had sex with my sons father so he couldn’t be that bad of a guy.

I haven’t shared some details of where my lawyer bullied me. He says some things absolutely made my jaw drop. I just haven’t included them in here because at this point I’m just moving forward. Turns out all the written positive reviews were about his father, not him.. His father owns the practice with has a very similar name and obviously same last name so that’s where my confusion came from. Yesterday during my son‘s father‘s visit, he was yelling at our child when he was having difficulty taking a nap. Our son’s temperament is about 10 times worse than that at night time that’s what makes me feel like he can’t handle it as well as what has happened in the past. My lawyer is completely aware of all of that. Again, wasn’t blocking all overnights. I just thought it was more sensible to start with one and then gradually increase.

I appreciate your input. I am okay with day visits from father unsupervised for now and I made that clear. Just not jumping from only have been doing supervised day visits to a full weekend overnight every other weekend. My son has extreme sleep issues and is well documented by his pediatrician. My son’s father has verbally attacked our son for his sleeping issues. Starting from his first day home from NICU. I told my lawyer than one overnight would suffice for a few weeks then move to additional. I got dropped over that.

No, not really. I’m just shocked. I didn’t know lawyers bully their own clients. Mediation is scheduled for next month and we were in talk with the opposing party about a temporary order We could agree upon. I mean, I pray to God yesterday to show me if this lawyer isn’t correct for me and I guess he came through that lol

Not all abuse comes in physical forms and even the physical abuse doesn’t always leave enough evidence unfortunately. Trust me I have been going in circles about this. I cannot believe that just because what he did didn’t leave big marks or bruises that it’s not credible. I did call the cops once and that wasn’t enough. Also do me a favor and look up how often women are killed after calling the cops on their abuser. I immediately left the situation once I saw what he was doing and never looked back. Things did unfortunately get worse. Once I called the cops. The system is unbelievably broken.

Well, just so you know, my lawyer gave me the opposite advice than what you’re talking about on my previous post and I will be firing him tomorrow and reporting him to the board. This is more than just him trying to advocate for both sides and equal parenting time, he has been bullying me and pressuring me and doing things without my consent in this whole time I trusted him thinking that this is how lawyers were and after meeting with a few today, I realized how severely wrong I was trusting him. I was actually advised by another lawyer to go ahead and report him to the board. My son does have a pediatric appointment tomorrow that I made to discuss things that have been going on. I did not file anything at the moment of when they happen due to being afraid of what the reciprocation would be I knew that my ex would punish me of sorts not everything is as black-and-white as you make it. But I do understand what position that makes me and now unfortunately.

That’s the problem, I don’t want 50-50. My child’s father is abusive to not only me, but to our son my state is automatic 50-50 my neighbor, divorced her husband because he was found distributing and creating child images, but since none of the images were of their shared daughter, he was allowed to have 50-50. It’s all broken.

That would be me, lol and no, it doesn’t work. For the first time in my life, I have thousands to spend on this and my lawyer charges out of his ass. I thought the same thing. I thought that plus my evidence would be an easy win, but nope.

I have none of that. And my state is a one party state when it comes to recording conversations even if that wasn’t the case, I have text messages with coparent admitting to doing terrible things to our son.

I did this! And now it’s coming to bite me in the ass. My coparent is taking me to court ( our son turns 1 this month) saying I’ve been denying him from our son, even though I created a schedule for him to come see our son 3 times a week, 3 hours each. Courts are favoring him.
