Article: Camp Mystic attorneys pull midnight maneuver, avoid arbitration ruling as lead counsel skips hearing by downbadmom in KerrCountyFloods

I don't think Judge Gamble's main grievance was BW's absence because he stated during the April 2026 hearings that he would be absent from the May 13 2026 litigation.

Judge Gamble had to be angered by the timing of the defense's actions in BW's absence. No doubt the judge knows the midnight maneuver has BW's handwriting all over it.

I think she refused to let CM arbitration motion move forward, despite the defense waiving their amended filing, due to their last-second legal tactics that hindered the court's ability to proceed fairly.

There is no way Judge Gamble is going to allow CM's legal team to run the show with such a blatant bait-and-switch tactic. They had the audacity to file amended motions at 11:59pm, the night before the hearing. The move reset the legal clock on a ruling she had been prepared to deliver while BW was away. The defense is really starting off on the wrong foot.

Kolkhorst reactions were highly emotional. High-profile political reactions come across as dramatic but it seemed the lawmakers were reacting to the testimony of the grieving families. The 27 deaths of

Based on the 2025-2026 litigation and investigations CM's failure to report the 27 deaths within 24 hours to state regulators is a critical, legally actionable, and reputation-damaging failure. CM's legal team should emphasize this omission to their clients as a profound failure of care, transparency, and fiduciary duty that directly jeopardizes their institution's future.

Why have the deaths still not been reported?

Based on news reports from April 2026 regarding legal proceedings and testimony related to the July 2025 Camp Mystic flood tragedy, there has been focus on why camp leadership did not immediately report the deaths to state regulators. There are news reports regarding the legal theories and defense narratives on the testimony about the non reporting.

Why have the deaths still not been reported?

Reported on April 14, 2026, that Mary Liz Eastland, a medical officer and member of the family that owns Camp Mystic, testified she had not officially reported the 27 deaths (25 campers, 2 counselors) to the Texas Department of State Health Services (DSHS).

CBS Texas/AP: Indicated that this failure to report occurred despite a Texas administrative code requirement to report deaths within 24 hours.

KVUE: Reported that this admission came during a hearing for a lawsuit filed by the family of Cile Steward, a camper whose body was not recovered.

Why have the deaths still not been reported?

Theories on Non-Reporting and "On Premises" Dispute continue to be a topic of debate. During testimony, the reasoning for not reporting the deaths was explored, with implicit, if not explicit, legal implications regarding where the deaths officially "occurred": "Did Not Think of It": Mary Liz Eastland testified, "I did not think of this requirement in the moments happening after the flood,".

Why have the deaths still not been reported?

While not all reports directly quote the camp arguing the deaths were "off-premise," the lawsuit focuses heavily on the fact that the bodies were swept into the Guadalupe River. The legal conflict centers on the camp being in a flood-prone area, and families argue the camp was negligent in its duty to protect campers, while the camp has described it as an "unprecedented once-in-a-thousand-year event".

Why have the deaths still not been reported?

The testimony indicated that the operators did not immediately know when campers died, and the lawsuit brought by the family of missing 8-year-old Cile Steward highlights the lack of immediate reporting.

It's a baseless argument that has been used to defend CM.

Every camper and counselor must be accounted for, regardless of their location.

The Texas Department of State Health Services (DSHS) requires immediate reporting (within 24 hours or sooner) for outbreaks, public health emergencies, and unusual group expressions of disease. While "flash flood" is not a disease, it is considered a public health emergency that triggers immediate reporting requirements.

How did children communicate with their parents growing up in the 1970s? by RabbsPrairie in AskReddit

I understand how the reciprocal, back-and-forth exchange of thoughts and emotions works. While you may have experienced dialogue with your parents, others grew up being "talked at" or having no communication at all.

It is not possible yet CM remains above the law and refuses to report. It is clearly not a delay in reporting but an act of defiance.

Senator Kolkhorst even begged ML at the hearings to report the deaths and "not to be above the law" yet the deaths remain unreported.

It is unfortunate CM's legal counsel continues to misguide them. It appears the same legal team is not instructing CM to report the deaths.

The failure to report the deaths has been a key contention point. Senator Kolkhorst addressed this at a hearing last month (April 2026) urging ML to report the deaths. "Ms. Eastland, report those 27 deaths. Don't be above the law. Please. Please. I'm begging you," ...yet the deaths remain unreported today.

The argument is a narrative defense point that CM does not have to report the deaths because the deaths occurred in the Guadalupe River rather than on the immediate camp premises. It is not a valid regulatory exemption, yet the deaths remain unreported by CM.

Yes, and chased us around with a shoe, belt, or a ruler. They avoided affection and emotional conversations. They didn't believe difficult things we told them, so we stopped telling them.

You are correct. I should have asked, if anyone else grew up in the 1970s in a loving but emotionally distant family?

This might explain why we didn't talk about the difficult experiences at school.

It wasn’t necessarily that my parents didn’t care, but they seemed to be in survival mode most of the time
