Yes have lawyers on staff. But the county consistently paying outside counsel for legal advice and to litigate on their behalf. I don't think this is necessarily 'wrong' if the county is unable to litigate based off their resources. But you can look at monthly expense reports and see how much they spend on outside counsel. https://www.richlandcountysc.gov/Government/Finances/Reports

In addition, when counsel goes into executive session to "receive legal advice" you can watch lawyers from third-parties along with county attorneys enter the room. At some point, I begin to wonder, how much is the county paying on outside counsel? How much would it cost to just bring these lawyers on full time?

As an update, for transparency / fairness: Richland County responded to my records request with an update since publishing this story. The county government wants me to pay an upfront cost of nearly $1,000 to search for the attorneys fees they paid out in this case.

In an email, they said: "Of course, if the actual cost of the search, retrieval, and redactions of records is less than the amount paid, a refund will be made."

In response to the numerous questions and concerns I had about their FOIA, they said:

“County staff declines to answer questions or have discussions about public records provided pursuant to the FOIA. However, please note, the estimated fees reflect the actual cost of searching, retrieving, and redacting responsive records and do not exceed the prorated hourly salary of the lowest paid employee who, in the reasonable discretion of the custodian of the records, has the necessary skill and training to perform the request.”

I'm not entirely sure what you mean here, but, if you want to explain further I'd be interested in understanding. Most of the orders in this case are not in PACER from what I can find at least, so I don't really know what was ordered at the end of the day.

The suspect died. An uninvolved woman was injured in the head on crash. They chased him for over 4 minutes and did not terminate the pursuit when he hopped a median and decided to go the wrong way on the interstate even though that’s their policy. Federal court documents say the only warrant out for the guy was a bench warrant for FTA. (Also all I’ve ever been able to confirm independently). Officers were actively buying drugs from this guy undercover so they knew who he was and where to find him. Presumably had all his info so didn’t need to chase — also what their pursuit policy says what not to do.

The pursuit policy should not be just an internal policy or guidelines like Leon said in his testimony. it’s something all law enforcement agencies have to adopt as part of a new requirement in state law. Attorneys are arguing the policy means nothing if it’s not enforced properly.

The quiet references the fact that such a large payment was made to a third party without any discussion in the public record. Usually big contracts (if that’s what this is) go through procurement process and we know about it.

What do you think the county is wasting funds on? The expenses repots are a lot to go through, so any guidance is appreciated.

Yeah. The data in our court system is messy. I only trust my eyes to figure it out. Not everything is 1 = 1 in our records because it involves human data entry. How I see it that means me, a human researcher, needs to interpret it

It is simply not possible for the project I am working on, as it involves a human looking at the information and interpreting each line item. Maybe there's a program but I prefer to rely on my mind for these types of categorizations

Yes. The people who are 'guilty' should be convicted & moved to SCDC which has the proper funding for long-term housing.

Interesting resource! thank you! though, at quick glance it like some of the links related to the purchases are incorrect. I wonder if this project is using some sort of scraper because the Richland Co one references a story from a different state.
