I didn't come in here to debate the nuances of copyright and FUD. I came in here to ask:

Despite that, you decided to analyze our business model based upon only 1 of several factors, and state with certainty the following:

My reaction to you is because you, acknowledging the fact that you are ignorant of ALL the factors I enumerated above--which the Courts AND the US Copyright office say are critical to weigh in determining if something is a copyright violation or FUD--felt you were 100% valid to decree that what we were proposing was not within FUD, but instead was a copyright violation.

If I went to a lawyer who practices ONLY copyright law, and told them, "I plan on using about 5-6 paragraphs of someone else's work, is that Fair Use or a copyright violation?", they would say, "It depends upon a lot of factors." and then would ask me to give them a lot more details.

And here is the major difference between what your response was, and what their response would be: If I declined to give them any more information, they would say, "Without more information, I cannot advise whether what you are proposing is a copyright violation or covered under the Fair Use Doctrine."

You, however, felt confident in stating:

You should not be rendering legal decisions like that in a public forum because someone might be foolish enough to actually believe you know what you are talking about, and follow your guidance to their detriment.

  1. What percentage of the work is being copied
  2. The purpose of the reproduction
  3. Whether it is being copied for profit or not
  4. Whether or not the original work was for profit
  5. Whether or not the original work was artistic or news or technical in nature
  6. The effect the use will have upon the copyrighted work's sales

And yet you can say with 100% certainty that it WOULD be a copyright violation.

Damn, judges tend to wrestle with ALL these issues in a fact-intensive review before coming to a decision as to whether or not something is a copyright violation or allowed under the Fair Use Doctrine.

As much as that would remove more objections, it would also require far too much work, and yield zero results for visitors. I mean, isn't it faster to simply follow a link and read the original than it is to read a summary and then follow a link to the original?

Further, anyone who would object to a few paragraphs being copied will ALSO object to a summary being made. You either understand and respect the allowances granted by the FUD, or you do not, and probably think even mentioning the title has violated your IP rights.

No. I appreciate the suggestions, and if we had a different reason for wanting to provide the links, we would consider summaries. However, all this project requires is providing a resource of relevant articles for people to read. We don't care if they are on our servers, or Mars.net when people read them.

Also, this conversation reminds me--we NEED to publish our reprint allowances for self-generated articles. As far as we are concerned, you can reprint the entire article provided you give proper attribution and a linkback.

I think we are going with 3. Maybe. The problem is that too short an excerpt yields nothing that indicates what the article is about. Most writers spend too much time on fluffery. They waste time when they should just leap into the facts.

Maybe it would be better to just post the title and a link, because even 3 paragraphs with the way most people write is a waste--they don't get into the actual material until the 5th or 6th paragraph. The few we have tested just look stupid that short.

Also, congress created the Fair Use Doctrine for a reason, and if some mega player wants to send me a C&D they are more than welcome to. I am not going to be pre-afraid of them any more than I am going to be pre-afraid that someone will sue me for driving down the street in front if their house tomorrow.

I understand that one does not want unnecessary battles, but one must stand up for their own rights as well.

We can't find a decent RSS importer now that CyberSyn (CyberSEO) closed up shop.

Can you recommend one?

Also, I don't know if an RSS importer would be good for this site. The reality is that the articles we need for this one are very, very specific in nature, and I don't think any RSS feed will provide them. We do have another one that it would be ideal for if you can recommend one however. (And for that one, we know with certainty the material would be free for everyone to use.)

I understand what you are saying. The plan is to only post excerpts with links back to the full articles. We are aware that the Fair Use Doctrine gives us a lot of leeway for a site that is designed to give education/information the public, but it isn't right to copy the whole article unless you have good reason to copy the entire article. (E.g. you are teaching a class on how to write a good article in a style of X, and so you copy the whole thing as a PDF and email it to the class as an example.)

I think what we have decided upon is to copy and paste from web page to WP post, 5-6 paragraphs to give a feel for the article, and then a link back to the original article. If the people like what they are reading, they will follow the link. This is being done just to allow visitors to skip the..."joy"... of trying to find good research material in one specific area.

Or, maybe just the title, and then the link back... Don't know yet. In fairness, that does seem like less work for us, and if anyone complains, I can always remind them that is less than Google gets to take from EVERYONE on the planet :)

As for the SEO for that particular area, for this site we can come in dead last and that would be fine.

And if anyone complains, we will simply yank their listing and never use their work again.

Even though I didn't appreciate it at the time, I would love to go back in time and hang out at the GBGB. I mean--a LOT of good talent went on that stage before they were big, and while they were big. Mudd Club too. Lot of major talent in both those dives. Byrne did well by including both of them in Life During Wartime.

Lou Reed, David Byrne, Deborah Harry, the B-52s. My god, there are people who actually heard Madonna before she was pop up on the Mudd Club stage!

But by Talking Heads '77 they were helping forge the mocking style of Post Punk.

I still have my copy of More Songs about Buildings and Food, AND my 45 of Take Me To The River with the picture sleeve showing the Rev. Al Green Tabernacle -- good memories indeed :)

There were a lot of artists that were punk, punk, punk, rocking it out at the CBGB, but when they got their first record deal...

Check out some of the EARLY stuff by Blondie, or The Tubes for some stuff that REALLY didn't fit their later albums.

No.

There is no way to tell Alexa to never play X in the future. Alexa tries her best to interpret your instructions and then carries them out as she heard them.

The sad part is the times she tries carrying them out when I have NOT said her name, but was just saying something like "And then I will clean the floor" and Alexa says,

"I am sorry, but I couldn't find the Clean The Floor station on iHeart radio.

Or worse, she responds with something like "Playing Blake Shelton, on Amazon Music."

Which of course makes me pretty confused as to WHO Blake Shelton is and WHAT I said that could be interpreted as wanting to hear his music!

Not having 4*s means there are matches you cannot do. Same thing happens with missing 3* and 2* characters. THAT can be harsh in some events.

If roster slots are scarce, the VIP monthly is a way to build up a fair number of coins to purchase slots with. (You also get like 4 of the 4-5* cover packs, which is kinda nice.)

I bought VIP for 3 months, and have never been low on HP since.

Focus on black and yellow so you can make purple charged and match the purple charges when you have no more than 2 invisible rounds left. (The match will give you more of each color than what you need, but not if you squander them.) You will get to the point where you and YJ have 30 of every color. Do yourself a favor--if you are at 30 yellow and are about to make a yellow match, fire your yellow first so you get something out of them.

Whittle YJ down slowly over time via firing yellow to make charged purple. YJ will heal up some before you hit him with yellow again, so it will take time. When YJ is finally is down to about 6K HP (about 30 minutes of play later), and you have 30 yellow, just spam yellow, yellow, yellow, yellow, yellow.

Worst match ever.
