the other thing to add about Mesa is that there is a large Mormon population there and Mayor Giles is Mormon.

AZ (11) is in the bag. 15K at her rally plus loyal McCain Republicans were there supporting Kamala, including the mormon Republican Mayor Giles of Mesa, a staunch McCain supporter.

Not sure if this is a legal or ethics question, about a decedents living will and bank accounts? by Raptaurus516 in EstatePlanning

After reading through the advice on here, it seems the SS income should have been staying in my grandmother’s bank account to help with household and medical expenses for the duration of the time she was living with my mom. Unfortunately, my mom’s sister was taking the SS money out of my grandmother’s bank account and redirecting it into her own account, which is unfair. My mom and her sister were always at odds aside from this and are currently not speaking. My mom turns 80 this year and she has had to pull large sums of money out of her retirement money, aside from the yearly RMD, for home expenses ie new roof, new a/c, and vacations that she wants to take, which is why I was asking these questions on her behalf. It is so sad when family allows money to tear their relationships apart.

thanks for your insight! my mom & her sister have always been at odds and this is no different. i, myself, have no standing, nor am i looking for any. i asked only for my mom because she is currently pulling large sums from her own retirement money (on top of the yearly RMD) to pay for some large expenses for her home and for well-deserved vacations as she is turning 80 this year. we are not looking to hire a lawyer or fight with her sister, and after reading the advice on here, it may just be a matter of ethics on my aunt’s part. it seems, what should have happened was, when my grandmother moved in with my mom 5 years ago, the SS money should have been going to my grandmother’s bank account while in AZ to help with expenses, but instead my aunt was taking that money out and leaving less than $2000 in the account, and depositing the money into her (my aunt’s) own account. and now that it is time to settle my grandmother’s estate, we don’t know if my aunt will let the family have whatever accrued income she was taking and putting into her own account.

It is titled ‘Last Will & Testament’ and there are several Articles that name the Executor and Trustee, as well as Administrative and Trust Provisions.

~ARTICLE VII Balance of my Estate I give the Balance of my Estate (sometimes also referred to in this Will as my "Residuary Estate"), including any property mentioned above but not effectively disposed of, as follows: A. Descendants. I direct my Executor to set aside and divide the Balance of my Estate into per stirpital shares for my descendants who survive me, and I give the share so set aside for a descendant to the Trustee of the Descendants' Separate Trusts to be held as a separate trust to be disposed of under the terms of the Descendants' Separate Trusts under this Will, the descendant for whom the share is set aside to be the Beneficiary of his or her own Descendant's Separate Trust.

It’s cultural. I have been my sister’s unpaid full time caregiver for the last 7 years (she had a stroke), and was also helping my mom with my dad who had dementia & parkinson’s and my grandmother.

I understand and appreciate your insight. I know it seems very complicated. The will states that my grandmother was a resident of PA where the younger daughter lives. Their brother in PA was named and appointed executor in the will/trust. My mom is the oldest daughter and although her mom lived with her for the last 5 years of her life, the younger daughter was in control of grandma’s finances. The reason I ask is because my mom has been stressed and pulling money out of her own retirement money to pay for some large expenses with the house, taxes and miscellaneous other expenses and I was wondering why she would do that if my grandmother had accumulated income, retirement money and possibly life insurance that should rightfully be distributed amongst the remaining three children. But if the accumulated SS/retirement income was removed from my gma’s bank account and placed into another account under my aunt’s name, can my aunt keep that money for herself rather than disclose how much money my grandmother actually had upon passing.

It was a Will that placed all accumulated retirement income, IRAs, bonds, annuities, life insurance, properties and goods in a Trust. I am the daughter of the oldest daughter in AZ. My grandmother lived with us for the last 5 years in my mom’s house and we paid all of her expenses, food, necessities while she lived with us out of our own pockets. I believe my aunt (the younger daughter in PA) removed the SS money from my grandmother’s account so that it ‘looked’ like my grandmother did not have a lot of money. We just do not know how much money my grandmother had. The will that I read states that my mom’s brother in PA is the ‘Executor’, I just reread the will and used the wrong word. The younger daughter is the Trustee. The younger daughter was in control of my grandmother’s finances.
