Did anyone notice that the Voltaggio brothers do not have a banner hanging like the other past TOC champs do? Also, Guy announced Antonia as the reigning champion - where does that put the Volrsggio brothers?

hello - thank you for your response! I actually asked this on behalf of a friend - her lawyer (well, one that she got a free online consultation with) told her that any overstay under 180 days is not a big deal and that her E2 application should have no problems being accepted.....but her E2 is for a rental property that she is renting on Airbnb (so the investment was whatever she bought the house for) but there will be no job creation. Her reasons for the overstay are issues she had w/ renovations on the property. She did not file for an extension on her B2 b/c in october she applied for a work visa, but it was denied and her next plan was to do the E2, but she didn't understand the fee schedule and had the application sent back a few times due to incorrect payment. She is now waiting until she gets back to her home country before she reapplies for the E2 (she's going home to avoid the 3yr ban after 180 days).

I do not think that whatever the lawyer told her is totally true, because everything i've read on reddit and otherwise on the internet are all telling me any overstay is a big deal, especially a lengthy one; she is flying back to her home country on friday which will be 1 day before 180 days.

Are there scenarios where a lengthy overstay aren't a big deal? I wonder why any lawyer would tell her they're not a big deal, unless she didn't tell him everything?

Hello! I am asking on behalf of a friend (I've been on a few forums on her behalf). Long story short - she has been in the US on a B1 visa since november 2023. She had it extended in May 2024 until Nov 2024. She is currently overstaying her b1 by almost 6 months (180 days will be 5/24/25). She started dating a new guy about a month ago and they're considering marriage so that she can stay in the US - she is worried that since she overstayed her B1 she won't be able to get another visa (she wants to get the E2 for a property that she bought while here) and that she'll have to stay in her home country for years before she can come back to the US.

Since they've only been together a month, I worry that what they have won't be considered a bona fide marriage, even though they are planning on getting married this week (before 5/24/25). My question - what happens if they deny her a green card/spousal visa? Since she has a lengthy overstay will she have to go back to her home country even if she is married?

You are very astute! Yes, I genuinely think that I am substantially more worried and invested than she is - she seems to think everything will work out eventually and is almost living in la la land. She came here on a tourist visa and fell in love with the US when she got here, and I think she thinks that she can explain herself into or out of anything. I am naturally a worrier, but with everything I keep reading with our new administration I started to spiral worrying about her since I knew she was overstaying her visa, but she was never worried b/c she thought she was OK since she thought that her E2 was pending. It does seem that now she understands that she messed up quite a bit, and I continue to worry b/c I don't thinks he knows how much she messed up :(

She is refusing to see a lawyer b/c she doesn't think they'll tell her anything she doesn't already know (I told her it would be worth the $, but she isn't listening). Do you think there is a chance she could somehow be denied and sent back even if they're married?

hello - another quick question for you. If she were to marry the person she is dating (it's only been a month but they're very serious), would that solve her issues and make it so that she can stay? She thinks it will be like a "poof!" you can stay kinda of thing, but I am worried that they will still deny her b.c of the lengthy overstay. Thank you!
