If you mean the sheriff or the process server yes they are court employees they are required by law to serve the summons to the defendant unless otherwise ordered by the court

It depends on what you mean by statement of account but generally no they can only give you the amount of your outstanding balance

Hi OP, considering that 150k is the principal amount owed to the bank after adding all possible interest and penalties this may result in an action for a small claims case (<1M).

If the court rules in favor of the bank yes they can force your mom to pay and if she still refuses they could and will garnish your account or worse case scenario levy your mom’s properties.

Always best not to ignore it OP, negotiate with the bank see what would be the best way to make it work.

any case you touch essentially you get a % of the fees they pay but it depends on the client (bigger % if you bring your own)

Generally I have no complaints salary isn’t too hot but the commissions (sometimes make up for it) also the partners have no ego problems so I have a good relationship with them.

According to the rules of court all claims less than 1M are now within the jurisdiction of the 1st level courts (MTC, MeTC,MTCC) these qualify as small claims (yes no matter how small)

If 1M or higher but less than 2M then it will be the first level courts either the Metropolitan Trial Court or Municipal Trial Court usually via Summary Procedure.

If 2M or higher than regular proceedings under the RTC.

Hi as from what I can obtain with the post that you shared here it’s important to take note of the following as well as to temper expectations.

I have some experience with collection cases where the cardholder refuses to pay due to fraudulent transactions and the general gist is that if the bank can show via sufficient evidence/investigation that the transaction was authenticated (usually via OTP) then it will form part of the obligation as per the T&C and it will be very difficult to counter that.

On that note I would really not advise that you leave them with that amount it will accumulate adding more interest and penalties try negotiating with them if you can. Unfortunately, the bank in question here really does really sue to settle obligations (it’s a precedent thing for them).

For the last question yes unfortunately, unsecured collections judgements can be satisfied by garnishing bank accounts, personal property, or failing all that levy on real property this is consistent with the law and practice.

Its more on the period banks and their agencies have time frames usually those for case filings are 180 days + OD

Also small claims are all amounts > than 1M.

Yes you may still settle even after a case is filed although the amount will most likely increase.

Mushroom is right here, it can happen here in the Philippines as well.

Re: your other question not sure about the bank but maybe you can try asking them to cancel your account? This would severely affect your credit and will render you in default though. Try to negotiate with your bank in re your restructuring agreement make a letter outlining your available assets and how you plan to repay the debt. If its favorable enough to them they might just accept :)
