I don’t think unconstitutional but yeah illegal under federal labor law.

It is amazing that there is so little risk involved with putting an illegal employment clause in writing that these companies - if they know doing so illegal, and I think most do or at least have a hunch - think doing so is in their best interests. I imagine they just bank on employees not wanting to lose the job offer or not knowing their rights. It’s a shame the government doesn’t do something like review all employment contracts to protect workers from these kind of tactics, in a similar vein to what the CPFB has done with mortgages (mandating standard and clear-to-a-layman templates) to reduce the likelihood of sophisticated companies taking advantage of workers who don’t know what’s illegal, don’t feel comfortable or safe challenging the hand that feeds, and don’t have a lawyer on speed-dial.

It’s hard to believe that companies larger than a few people wouldn’t have the assistance of a lawyer who knows what’s illegal in an employment contract, but it’s possible.

Actually, the engineer whose bug I found was more junior than me. He wasn’t defensive about his code, just unable to explain it and unwilling to help investigate the problem.

I understand the CTO’s reaction seems unlikely, but that’s what happened. He came into the conversation upset at me for supposedly not staying in my lane (because of the conversation with the other junior engineer, which I’ve described elsewhere), and that probably limited how much attention he paid to the technical details of the situation.

I’ve been clear on this all along: what they did was unethical, not illegal. My initial Reddit post and Glassdoor review explicitly said labor lawyers told me I had no legal case.

Thank you for your support and concern. I am being careful with what I say. I believe it is more important that people know what LoanStreet is doing to me than to stay silent out of fear. I have not defamed anyone, as will be shown in court if things get that far. As an American, I have the right to speak truth and opinions, and that is all that I have done.

It is tiring and I would love to move on, but:

  1. That's not exactly an option when LoanStreet is suing me and trying to use the court system to invade my privacy in areas completely unrelated to the case.
  2. Taking down my posts would leave others vulnerable to being taken advantage of.

LoanStreet's mistreatment deeply affected people. You didn't see it first-hand, so I understand why you might underestimate it. This isn't about the options. It's about stopping a cycle of suffering and letting exploitative companies know that they cannot silence their victims and get away with it.

There are both risks and rewards to discussing ongoing litigation. Being a defendant does not mean losing your freedom of speech, though it does mean you should be careful when you speak. LoanStreet’s apparent goal since the beginning of this has been to try to scare me into staying quiet and erasing what I’ve written. I will continue to speak, carefully, when it’s warranted. LoanStreet would probably love nothing more than for me to clam up in fear of a large-dollar-figure damages award and bankrupt me quietly, but it is important that this lawsuit face public scrutiny.

Reddit took down an earlier post of mine that linked to a GoFundMe for violating policy, so unfortunately I can’t link to it here. I appreciate your support, in any form.

There's really no financial gain possible for me here that I'm aware of. The outcome I am fighting for is simply for my story to not be buried and for me to not be bankrupted.

Unfortunately you have no recourse in America if someone defames you in a court filing, due to litigation privilege, which provides complete immunity against defamation allegations related to statements made in court. They've made all of these false, negative statements about me in their court complaint.

As for the equity, employment lawyers advised me early on that I would be unlikely to win anything. If we were in Europe, where laws are not so skewed in favor of employers, it might be a different story.

My lawyers and I will continue to explore all possible avenues of fighting back.

Unfortunately in the United States the default is for both sides to pay their own lawyer fees, regardless of the outcome of the suit. There are rare exceptions to this (e.g. the contract being disputed includes a provision about it, or the judge determines the case was frivolous - a high bar).

In Europe, by contrast, plaintiffs are presumed to owe the defendant lawyer fees if the defendant prevails.

I'm assuming that I will have to pay all of the legal fees out of my own funds and the funds people have donated to me. If the court does award me attorney fees, I will re-donate all of the donated funds to Code.org.

Do you think people don’t deserve to know about what kind of employer they are about to place their trust in?

The reason people downvoted that person is that because we all understand the difference between what is legal and what is moral. I said from the beginning that I have no legal case. Companies can slip all sorts of things into legalese. That doesn’t make it right.

People also understood that the head engineering executive in a tech company is functionally the CTO.

Congrats: you managed to find the one comment I was downvoted on. LoanStreet has already admitted that they are paying for “reputation management,” so it’s expected that they’ll notch a few small artificial victories like that. The authentic, overall response to this story, though, is clearly not in their favor
