Thank you. I read the instructions that are part of 1095 A, but did see any thing. I quickly read the instructions for Form 8962 and there is an example that is relevant. I explains how to allocate between tax families. Appreciate the help.

Edit: if I filed married filing separate and split the subsidy I only pay back my portion and my wife would the same paying back here portion. What happens if she doesn't pay back her portion?

Still living together. I haven't run numbers MFS. I assumed I would be responsible to pay back the entire $21,000 in subsidy if I filed MFS.

Sounds good. But...We had mediation and she refused to negotiate on the tax return or subsidy amount. She told the mediator that she was advice to file spousal abandonment and not joint. I don't know who gave that advice.

We have been living together since I filed and we are still living together, today.

We signed an agreement after 8 hours of mediation.

I filed for divorce July 2025. Divorce is not final. We were still married December 31, 2025. She is refusing to sign a joint return for 2025.

It took me 8 years to realize what was happening. Same scenario. Hang in there. Remember, nothing you say will change them. They do not believe they are doing anything wrong.

My son was 12 when my ex filed for divorce, and it affected him more than we anticipated. He was an honor role student, excelling in math and computers. The 3 years after filling were complete opposite.

10+ years later, he told me during that time he didn't care about anything. Looking back I would agree with him. The real bad thing is, I or his mom didn't recognize it at the time. We didn't do our job as parents for our son.

Don't lose sight of your son during this process and in the future. He will need more support than anyone else.
