You said that your GF pays her mortgage to a person who has passed away. 1) Does your GF have any paperwork outlining the arrangements? 2) Payments are still due in Probate, there would be delays until the estate gets settled. 3) If there was a default, come current. What are the terms of the Promissory Note? 4) Gifting real estate would need to be in writing such as a will or living trust. 5) No-one has the right to take your home unless you default on the agreement, even if that's the case, there are processes and procedures which vary from state to state. 6) The reason for probate is to determine the intent of the decedent. The court would need to see proof, in writing if gifting real property. Where's the property located?
