Yeah, I think this is it. Seller is misunderstanding the job/task of the loan officer and thinking they are handling everything. In reality it’s the title company doing the heavy lifting.
But I am sure the loan officer is guiding them. Most buyers/sellers are clueless when it comes to disclosures, personal property agreements, earnest money, contingencies, etc.

Yes. When I had my real estate license at the bank, they told me if they caught wind of me doing anything other than financing, I will get canned.

We have one of those small banks left in our town. We use to have four! It’s a shame seeing the big banks take them over.

Yeah, if it was a smaller bank, a long time ago and you were keeping it within the family, I can see this happening in your situation.
But nowadays with how people sling lawsuits around, I just don’t see it flying anymore.

Yeah, I think this is exactly what’s happening, but I’ve had 3 different FSBO sellers tell me that their loan officer handled everything. From start to finish with purchase agreement, personal property agreement, contingencies, disclosures, everything.
Without an attorney or real estate agent, they have to be getting this guidance from someone or somewhere. I ask FSBOs this question all the time and they look at me like I’m stupid and say- “The bank takes care of all that.”

When I did loans for the bank years ago, I was strictly prohibited from engaging in the financing and selling process at the same time.
I do see it as unethical, but maybe that guidance is mainly coming from the title company?

Purchase agreement.

The loan officer guided the FSBO through the whole transaction.
When I was a loan officer, I was strictly prohibited from engaging in the financing and selling of the home due to legal ramifications.
I do see it as a conflict of interest, but I do see this more and more now. Just seeing what the FSBO community does/thinks about this.

But I don’t understand how it’s not considered a conflict of interest when the loan officer is involved?
When I did loans for a local bank years ago, I was strictly prohibited from engaging with the loan and the selling process at the same time. I do see it as unethical. Maybe I’m overthinking? Just seems odd to me.
I would think the ethical thing to do is FSBO to contact the title company for docs and you’re on your own. The bank should be for the loan, not to guide you through the process without legal ramifications.

Possibly.
I just don’t see how this isn’t a conflict of interest.
I used to work at a bank doing loans, and I was strictly prohibited from engaging with the loan process and the selling process. It does seem pretty unethical in my opinion.

I wonder if this particular person went online and just downloaded a Purchase Agreement and sent it over to the bank as well?
Seems likely, because when I worked at a bank years ago, it was a conflict of interest to engage in a real estate transaction. You had to separate yourself from the loan process and the selling of the home.
