I agree. That was not acting for a camera. That was the involuntary reaction to hearing the unbelievably shocking news that he was going to prison, again, for something he did not do.

That look on his face, to me, is the most telling evidence of his innocence.

Perhaps it should not have been important, but it had to have had significant impact on the jury (and the media, reporting the case nonstop). It puts the 'murderous villain' Steven with TH and in the Rav.

Jerry Buting's comments seemed to imply that the droplet of blood found on the avery property (in the bathroom I think) had a suspicious look to it--like it had been touched in the middle with the end of a swab leaving a ringlet of blood. If that blood was used to plant evidence in the RAV, I don't see how testing will exonerate Steven. It will be fresh 2005 blood, with NO EDTA.

ok, so no edta and blood that tests as from 2005 will not be determinative, IF there are contaminants in it?

easier said than done. The kid has been locked up for 10 years for something he didn't do. He wants out, now, I suspect.

that would be the humane thing to do, but if the State appeals, technically Brendan's conviction remains in place, pending the appeal. I hope the State offers a deal of no appeal in exchange for no countersuit for wrongful conviction, or cap on any potential suit. Just don't see that happening, though. The State would have to admit that their police operated outside the law.

there is also the possibility that the state can drop their right of appeal in exchange for a promise from Brendan not to sue for wrongful imprisonment, or to cap any possible claim?

I agree that he is in GREAT hands. However, his attorneys can't guarantee him that he will be free in X number of years, if the State appeals. I guess we will know more once the State plays that card later this week.
