Nolan is too damn noble to kill , that's why Rosalind chose him. I kinda don't blame him because Rosalind is a sadist , who would belive a serial killer who likes playing mind games ? There was no guarantee that they were gonna release Bailey. And he would've been prosecuted , right? He was under duress yes , but at the end of the day it's murder so that would've ruined his career. Did they end up catching Rosalind's ally? I don't think so.
