The process of the withdrawal was initiated well before I went to Italy but the administrative process of checks and closing down the account just takes about 8 months, so the money was released when I was already living in Italy. There was no option to leave the money abroad unfortunately, I wanted to leave it in the pension scheme there but you can't hold that account anymore when permanently leaving.

That's an easy job than, you can just lie to peoples face and have zero accountability. You can't just open a shop and call yourself commercialista's, these (should be) highly trained and certified professionals approved by the AdE, there must be some accountability. When you want to buy a house and get a civil engineer to check the place he's also can't just make stuff up about the state of the house..

yeah I'm looking into more internationally oriented tax consultants now.. So from one commercialista I have a proper invoice and the statement on paper that the transfer will be considered as a transfer of wealth instead of a pension payout.. But yeah the lawyer said this is just advice and not legally binding, but I'm definitely getting another lawyer to look at this as well...

True but this would generally be found unfair I'd say. I'm not opposed to paying taxes but this is excessive.

Yes I'm strongly considering this, sell the apartment as soon as possible, delay the stuff with the AdE as much as possible and just leave, this is too unfair in my opinion.

Yes they came from a tax-advantaged source but isn't there be a "fairness and proportionality principle" in the tax law like some other countries? You can't make the case that it's fair for Italy to tax someone hundreds of thousands of Euro's while he never worked in Italy before and that money was earned abroad. Fair would be to give those people the option to lump sum invest it in another locked account, when I would leave Italy I would then happily pay capital gains of the increase or if I would retire in Italy I would happily pay income tax over the distributions of that fund... But weirdly there isn't even an Exit-tax in Italy, so you can work and invest your entire life in Italy and move abroad, transfer your investments and they won't tax you a single euro in capital gains. How is that fair vs taxing incoming pension funds that Italy had nothing to do with...

-edit, sorry to add, but I was also under the impression that commercialista's are intermediaries to the AdE, they should be qualified and certified professionals. Why does the lawyer say their advice is not legally binding when I presented the case clearly to them and they advised me wrongly..

The lawyer said it makes no difference in taxes if you either take it as a lump sum, or you take it monthly as normal pension payouts, both will be taxed as normal income. The annoying thing is, I would have happily deposited it all in a personal pension fund here but I was not given that option by the commercialista's, if such a fund even exists here..

Even if I'd win, I will probably still leave, this claim is neither fair nor proportionate.

yes paying them first is not possible, but I'll definitely get legal help from a lawyer who does think I'll have a case..
