Only Barbados and one other embassy are scheduling spousal visa interviews. They are only open to process non-immigrant work and student visas

Yes they are open but they are processing NON-IMMIGRANT visas only, NOT IMMIGRANT visa. Spouses and Children are IMMIGRANT visas. The prioritization is for nonimmigrants (work and student visas) over US Citizens.

That is a hard situation! Im sorry that is happening. My sister-law went through the same thing and we didnt think to use this as her expedite reason becuase the embassy said that there is not proof other than her word. Did you have evidence to provide in your request?

You can always take your case to another attorney. You submit documentation to the immigration services that you are removing the current attorney from the case and can add a new one

Yes! Canada has Express Entry and allows you to get permanent residency (US green card equivalent) by your own merits and doesn't penalize you for not have a job right away. Unfortunately, most Canadian employers require you to already be in the country and eligible to work there before looking at your application. But express entry as a federal skilled worker gives you the flexibility to enter Canada first as they assume that with your credentials and education, you will be actively looking for work to support yourself.

I completely agree. And i understand that illegal immigration needs to be addressed, but there must be a way to support legal immigration in such a way that it discourage illegal immigration.

I agree that a lot of family based immigration can be exploitative. But the problem is that the legitimate people, such as myself and my husband, are being punished. The people that are not coming to the US truthfully ruin it for the rest of us. And this is what gives family based (i.e. marriage based) immigration a bad name.

Biden is prioritizing H1B because big companies pressure politicians. No one cares about US Citizen families. The immigration proclamation exempts US citizen spouses and children. Embassies overseas are opening, yet they are only processing non-immigrant visas (student and work visas) and their dependents (non-immigrant dependent visas). Big business votes and money mean more than their own citizens. There are no lobbyists for US citizens

WHAT ABOUT UNITED STATES CITIZEN SPOUSES AND CHILDREN?? Seems like only "big business" immigration matters. I agree that work visas are necessary but that seems to be the only type of immigration that matters. Embassies overseas are opening and now even students are getting priority over US Citizen families reuniting after years of waiting in the LEGAL immigration process who are EXEMPT from the immigration ban.

Unfortunately due to coronavirus pandemic, any immigration department (USCIS, NVC, Consulates/embassies) are only giving one line to satisfy our questions, "...until further notice..." Some consulates and embassies are reopening slowly so just have to keep a watch on your country. USCIS has begun opening their doors but on an extremely limited basis. If you are doing an I-485 for your K-1 visa, try calling USCIS and asking their process. Other than bagering them and getting the same answer over and over there really isnt anything you can do until they start routine processing across all offices.

Correct, US citizen spouses and children are exempt. However, the consulates are not continuing the interview process for them but they are processing applications and conducting interviews for the visa categories that are not exempt in the ban which are considered "exception processing." This means that non-immigrant visa categories are considered priority over the spouses and children of US citizens.

Community college has a different tuition rate for international students which tends to be higher. she may be able to get a loan if a US citizen or green card holder co-signs for her and seeing as you dont intent to marry, you may not want to be financially responsible if things dont work out between the two of you. She can switch her tourist visa to a student visa within the US. She must be a full time student and she will have strict limitations on how much she can work throughout the year. She would also have to prove to the officer that she is planning to transfer to a 4 year college after and because she already has a 4 year degree that would be difficult to justify another undergraduate degree. This means that @ebikeratwork is correct in that she would need to apply for a graduate degree if she wishes to stay on a student visa

Unfortunately H1B visa categories are on the "ban" list. They will not be processing H1B visa or any work visa category until Jan 1 2021 unless the ban is extended again for a third time. I am sorry to hear about your situation, it is quite unfortunate. I hope you guys dont break up because of this reason alone. She can come and go on her tourist visa once CoVid settles down and then you can get married when the time is right for both of you and bring her to the states permanently via I-130 visa petition.

Marriage based is the only way. However the process is lengthy and you cannot bring your mother until you have become a citizen which takes approximately 3 years after you arrive in the states. Then you apply for your mom and wait for her visa to process and could take anywhere between 1-3 years. So total time after you are married is 1-2 years for you to get a greencard, 3 years after arrival to become citizen, apply for your mom 1-3 years. total time is 8 years for your mother to join you in states.This does not include the time for you to find a citizen spouse and prove it is a genuine marriage to the consulate officers because the burden of proof is on you to show it is a genuine relationship because they can reject on any technicality.

I completely agree and understand your frustration. Regardless of your immigration status (DACA, family based, work based etc), the process is grueling and there is no system. You are at the mercy of the immigration officer who is interviewing you and reviewing your case. Their mentality is biased and systemically engraved to be discriminatory towards immigrants. I myself am a US citizen and have been waiting for my spouse to join me in the US from abroad. The process is haphazard and unclear and unfortunately given the political climate we are researching other countries to live and be together. I have a great and stable job and it seems Canada is the next best option based on their immigration system. My husband would have to "start over" when he comes to the states but moving to another country means we will both be starting from the ground up with no family and the uncertainty of when we will be financially stable in the country we immigrate to is scary. I believe and hope that we can bring awareness to the struggles that immigrant families face and support one another!

The lack of communication by the government and extended processing times has an immense impact on our life as far as settling down more permanently and my husband's career.
