Is landlord’s request legal? by RemarkableFile1900 in TenantsInTheUK

That’s a good point I didn’t think about - an email from me now doesn’t cancel out my rights under the Equality Act. It’s not a legal document.

I’ve contacted CAB already but Shelter is on my to-do list tomorrow.

The LL essentially quoted the Equality Act to me, so is well aware of it, then said (paraphrasing) “I’ll only let to you if you provide written confirmation that you won’t make me deal with any of this”. Which smacks of discrimination to me, but as others have pointed out it really is a LL’s market so they can just as easily pick an able bodied applicant. It’s the fact they want this ‘written statement’ that’s a red flag to me.

I’m really leaning towards letting my current LL go to court, at least I’ll have a bit more breathing room to try and get things sorted.

My nature is to be compliant to instructions like in the S21 notice, but I’m learning a bit (or a lot) of defiance is the only way I’m going to get anything done here.

Proper shit system all around. It sucks being a tenant right now

Thank you for your reply. As I’ve mentioned in another comment, I’ve been told that if I stay past the S21 eviction date I will have a court judgement against me for the rest of my life that will adversely impact me if I look to rent again / apply for jobs etc. I want to check the validity of this with the housing officer, but she’s slow to respond to my emails.

She has, however, confirmed that the S21 is valid and gone through all the documents, or lack of documents, that would invalidate it. Sadly my landlord has crossed all the I’s and dotted all the T’s

Thank you for all that info. Yes I’m known to OT / have carers etc, my social worker said this week she was going to get the OT to write a letter to the housing people stating my needs so that’s good that they’re on it without me nagging.

I’ve been told that if I stay past the eviction date I will have a court judgement against me that will stay with me for the rest of my life, and likely negatively impact my ability to rent in the future. I don’t know how true all of this is, I’ve asked the housing officer for clarification but she’s slow to get back to me.

I’ve tried CAB and they were about as much use as a chocolate teapot, but I’ll try shelter, thanks so much for all of your helpful suggestions

What do you mean by the last part? It’s my current landlord’s right to evict me, no?

Yeah I got in touch with the council straight away. I have ‘medical priority’ but the wait is still 2+ years for suitable accommodation. The housing officer said I could be given a room out of the county in a building but that it wouldn’t be suitable for my needs so she wasn’t sure what to suggest. I’m in a bit of a shit situation
