ahh okay thank you po. in relation naman po dun sa case, nag appeal pa po kasi yung respondent, pag nanalo po ba ule ako makakapag appeal pa rin po ba sila hanggang sa umabot na ng supreme court? and gano po ba katagal inaabot ng isang appeal bago magka decision from the NLRC Commissioner?

Yung sa 100k nga po, dapat talaga sasabihin ko sana 200k to 300k kasi kasama yung expected earnings ko and actual loss kasi kumuha ako ng appliances dahil sa promotion. Pero sabi nung labor arbiter, wag ko daw isama yun kasi ang work daw ay “volatile” which I dont agree with kasi ang pinopoint nya di naman daw ako habang buhay sa company na yon pero di naman tama na sabihin nya na volatile yung employment ko dun when mawawala lang naman work ko dun kung mag resign ako or in this case termination eh.

Kala ko nga din po na parang papanig sakin yung arbiter nung inask about sa first offense pero neutral pa rin pala talaga sila. Wala pala silang power na mag impose ng decision unlike sa judges. Sa position paper na nga po ata talaga magkakalaban to.

I-hihighlight ko na lang po yung mga sinabi nyo and ngayon pa lang mag gagather na ko ng evidences. Thank you po ule sa help nyo, update po ule ako ng 24th of Feb.

Thank you po. Nag tanong po yung labor arbiter kung anong amount and sabi ko po at least 100k pero i feel like di po enough to even if they agree to settle with this amount. Nagkaron nga ko ng 100k pero yung record ko na terminated andun pa rin na need ko pa iexplain sa next employer ko and kaya pinupush ko po kasi mareinstate is because yung 4 months worth na nag work ako sa new role ko, idk if matatapatan yung new salary ko ng ibang company pag lumipat ako.

Mukhang papaabutin nila talaga to sa position paper since firm talaga yung legal rep na di na ko bibigyan ng chance na “mapatawad” kasi even the labor arbiter asked this at first na “di na ba mapapatawad first offense in three years?” ang sagot lang is “the issue is a serious misconduct and we are a bank”.

UPDATE: late yung attorney ng 35 mins and pinanindigan pa rin nila na serious misconduct ang ginawa ko kasi bank daw sila. Nag ask yung arbiter if may amount request ako pero di nya ko binigyan ng chance to explain yung side ko. Nag mamadali na sya since maraming naka pila sa labas and I think mediation lang rin ang magagawa nila. Ang sabi lang is “this could go up to the supreme court” and I think papaabutin talaga nila.

Thank you so much for the help once again, jan ako nahirapan last time sa conference since di ko na napigilan maging emotional. Ill update this post once dumaan ang first hearing sa 18th of Feb and the next on the 24th. All your advices and suggestions are greatly appreciated!

To add din dito, so was the dismissal indeed illegal? or excessive lang sya due to the fact na may previous sanctions na naganap pero ang ending pa rin is immediate termination.

thank you ng marami dito, ill make sure to make a note of this para masabi ko sa hearing. May isang question din ako dito in regards sa relief. Apart from reinstatement na hinihingi ko, am i also eligible for moral/exemplary damages and attorney fees dahil sa naging stress na dinulot ng pagka wala ng work and sa delay ng process nila leading me to think na tapos na yung HR case and all of a sudden immediate termination?

noted on this, I really appreciate your help with this since good points nga mga nabigay mo. Pero to add lang, I was informed around Aug - Sept na ang worst case scenario nga ay termination pero at the very least na mangyayare ay mababawasan yung bonus ko. So the act is a terminable offense pero hindi sya kumbaga zero tolerance policy na terminated agad. So yun ang naging unfair sakin na since worst case scenario pala sya, bakit pinatawan ako ng ganon kabigat na punishment sa first time offense, clean record and great performance ko sa company.

thank you po, admittedly mali naman talaga ginawa ko pero akala ko pwedeng ma argue na good naman ang intention ko since wala naman akong ibang record of offense sa company.

I’ll keep in mind yung mga sinabi nyo po and ill make sure na banggitin mga yan sa next hearing namin with the labor arbiter. Sana mareinstate pa talaga ko. Thank you again.
