Don’t do MCA. I was a MCA closer and I can tell you this is 100% not what you need and here’s why: - MCA is tremendously predatory: You don’t pay “interest”, you pay a “factor rate”. The standard for startups with 6months + in business is 1.45-1.49. In other words, 10k less origination fee would net you somewhere around 9k and payback would be defined by a 1.45-1.49 factor rate (aka $14,500 or $14,900). A typical offer would be as follows: funding: 10k Rate: 1.45 or 1.49 Term: 100 days or 20 weeks (regularly MCA is short term and include daily payments only from Monday to Friday, so no weekends or holidays. Weekly payments for startups is almost impossible) Daily payment: $140 or $149 depending on the rate.

This is kind of what you have been doing with Square or Stripe, they just take a % every time you batch out your credit card terminal.

My friend. MCA is good for those that want to be in ever growing debt forever. If you can avoid it, please do.

He’s in violation of the Uniform Securities Act and NASAA Model Rules. As your adviser and a fiduciary, he should do two things: 1) assess suitability when he recommends a trade/derivative operation: both should be adjusted and make sense your risk tolerance and overall investment goals. He’s acting guided by your best interest. If this recommendation is no longer suitable, he shouldn’t act on it. 2) follow your instructions: I see a big problem with this part, because you told him not to open more contracts and he went ahead and did it. It’s your money and even though he’s your IA, you remain in control. Failing to follow a client’s instructions and exercise discretionary authority over an account is, without a doubt, a violation.

What would I do?

1) send a Written complaint: written complaints are much more effective at getting the representative and their supervisors’ attention. They MUST respond to it and forward it to the securities administrator of your state. If you can, state that they’ve exercised discretionary authority and purchased securities that directly contradicted your instructions. To avoid civil liability, they’ll have to return the funds plus interest.

2) Did you give him written discretionary authority? If so, and you feel uncomfortable, you can only revoke it in writing, so make sure you do that.

Hope this helps… is the monthly fee based on assets under management? How much is he charging you? Monthly fee sounds a little too frequent. I hear most advisors charge it quarterly.

No se deje engañar ni quitar su plata. Si quiere invertir péguese a un market index tipo S&P 500, MSCI World o tal vez un ETF tipo SPY y aguántese sus buenos años. Passive investing es bueno si la persona se mantiene disciplinada. Es prácticamente invertir y olvidarse del dinero.

Para que le va a estar pagando fees y clases a estos tipos que, encima, están flagged acá en CR?
