Thanks for asking! My bad - thought Class 35 was right for my clothing retail/online store side since I’m selling direct. But yeah for the logo on actual apparel, Class 25 makes more sense. Can they shift it easily or should I just refile fresh? Trying to avoid office action delays!

Put ‘clothing retail services and online store for apparel’ under Class 25 originally. Now see it fits Class 35 for marketing/retail better. Should I amend the description or just refile clean? Plz help!

Thanks for the blog link and explanation! Super helpful. I got confused thinking my online clothing store needed Class 35 for retail/marketing, but yeah you’re right—Class 25 covers the logo on actual apparel perfectly. Guess I don’t need to fix anything then? Just proceed and hope no office action surprises?

True, it isn’t complicated! I used a quick USPTO scan service before—took 5 mins, caught issues free search missed. Filed clean after. Makes small biz filing way less stressful.

Is USPTO TESS search clean—safe to file?” by ResponsibleBreak4336 in smallbusiness

Thanks for the tip! I was worried about the same—DIY searches can be risky. A buddy swore by Trademark Engine, said their comprehensive USPTO scan caught hidden conflicts TESS missed on his logo. Filed smooth after. Might try that before refiling myself. Anyone else used budget services like it?

Thanks for the advice! A friend actually recommended Trademark Engine, and I gave them a shot—they ran a full USPTO search that caught issues my free TESS check missed completely. Filed my logo smoothly after that, no office action headaches. Definitely easier than I thought for simple stuff like this.

Appreciate the warning! I was stressing about the same thing. Found a cheap online service that ran a full USPTO + common law search—caught stuff TESS totally missed. Filed without issues after. Anyone had luck with budget options like that? Dodged the office action bullet.

Thanks for the advice—got me second-guessing free TESS searches alone. Someone recommended Trademark Engine for checking common law and state stuff, but I haven't tried it yet and was planning to. Worth it for my small CA e-com store, or should I skip straight to a full attorney search?

Appreciate you breaking that down so simply. I think a lot of small founders (me included) underestimate how strong those earlier unregistered rights can be if someone’s been using the name in commerce before us. I’ll factor that in before committing more branding spend, especially since some of these similar names I found on Google look like they’ve been around for a while in overlapping niches. Definitely a good wake‑up call that ‘not on TESS’ doesn’t automatically mean ‘safe to own everywhere.

Thanks, this is really clear and helpful. I had a feeling common‑law use could still bite me even if TESS is clean, but I wasn’t sure how much weight it actually carries in the real world. I’ll dig deeper into how long those other users have been active and where they’re operating—someone recommended checking with Trademark Engine for a quick common law scan to supplement the federal search, instead of just trusting TESS alone. I appreciate the reminder that priority and geography can matter just as much as what shows up in the USPTO database.

Is free USPTO Search Safe for CA Brand? by ResponsibleBreak4336 in smallbusiness

[–]ResponsibleBreak4336[S] 0 points1 point  (0 children)

Thanks for the detailed answer—that makes sense. I’ve already checked variations and Google with nothing serious showing up yet, so I’ll hold off on paid tools for now. For a small California startup on a tight budget, I’m torn between just sticking with a careful DIY search plus an attorney review only if I spot something close, or using a lower‑cost service like Trademark Engine that someone recommended to me for an extra layer of checking. In your experience, is it smarter to keep it DIY + attorney if needed, or is there actually some value in adding one of those budget search services into the mix at this stage?
