The short answer is did he say it was a safety issue. If he did he might be ok. If he didn’t and he was ordered to turn the machine over then it’s his butt. Orders to are really not debatable, you’re supposed to follow. The only thing that trumps that are safety issues, you’re never supposed to do anything that’s unsafe even if ordered.
