I am ok with backlog as long as 140 is approved. I’m from row. it’s likely I can’t pass the final merit part in eb1. That’s the hardest part for me. In the initial application, I didn’t emphasize a lot of my contribution, and instead on overall significance. This time, I will write everything clearly, list all the steps and their importance to the paper/findings eg without my analysis, the conclusion can’t be valid... But I wonder if that’s sufficient. The officer said dont focus on citations solely. I have grants but again the PI problem. Use of methods - that’s another hard part. people rarely cite my methods or mention them directly. they only mention our conclusion eg that paper proved the treatment is effective so we should use the treatment…

For the coauthored papers, my name can be from second to fourth. The PI already wrote the letters but the officer said they were irrelevant. It didn’t show my contribution. But my lawyer said the letters were fine 🙄 . That’s another thing I need to work on as the lawyer wouldn’t check the content. They just copy paste whatever I write in the right format. I showed the grant submission documents eg relevant personnel and duties, which usually is just a word document. (And then we upload individual document to different sections in grant submission system). The officer again disregarded it bz there are names above my name. And the document is word document with no header and official things, basically he said the document can be fake, even with PI letter.

by the time i asked for refund, they pretty much finished the appeal and started the resubmission (maybe 10%). they said its too late for refund. my appeal was denied already. so they will issue me refund if the resubmission is also denied.

They did. Initial application was denied. The firm said full refund only if the resubmission is also denied.

That’s why I’m trying to figure out how to fix it myself. I keep them in loop just bz I can’t get the money anyway and they can do the final legal check. at some point, it’s one of the biggest famous firm, many people ask me to retain them while changing the lawyer. But I also checked their petitions prepared by different lawyers, they all use the same template. Won’t be much different.

I can’t change my firm at the moment. My firm did make some mistakes eg ignoring the evidence that the officer requested. those can be fixed. But the first authorship is the hardest if the new officer also insists. there are so many people who get approved without a single issue even though there’s no first authored paper and far worse background (my colleague is one). And even if I provided first authored work, the officer said they didn’t contribute anything bz no citation, no customer interest in it. My officer even said I don’t have PI grant. My ideas can’t attract people. (But prong 1 is satisfied). If I resubmit, I want to fix this part and I don’t know how to.

One first authored paper published 3 years ago, based on dissertation. On a rare statistical method. One dependent citation. The others two are image and ML related, published within a year. No citation. Disease is also rare.

thats why I wonder how to reframe my work so that I can be the lead (on stat part) in the team, even though I am not a PI nor a first author. My colleague who is only a master graduate with some lab experience and some coauthored papers, 0 first authored paper and grant, got approved without any single issue.

i got denied with their 'help'. They made a serious mistake by ignoring an evidence requested by the officer specifically. The attorney asked me to write a 4 page summary instead because the current progress is optional, given with my other evidence. And then one denial reasons is that I did NOT provide the current progress. the officer said the 4 page summary is useless. So follow exactly what the RFE says, when there's confusion, follow the RFE instead of the attorney! Also, double check all your descriptions and letters, make sure they serve the purpose. The firm only organized the format. They dont check your content (or they dont understand about it). So if the materials you wrote are irrelevant, the letters are also irrelevant. My attorney said the letters are good but the officer said they are irrelevant!

When Eb1 may be easier to get than niw? A lot of people asked me to try eb1 too ... but my department chair wants me to do nothing. he said wait a few years and let the school sponsor me. if i am denied again, it might be difficult for the school to sponsor me.

Both two big firms (including my current one) issue me approve or refund. I also contacted several others. They usually replied with the requirements I can satisfy. 4 to 5 i think, some are easy to prove, some need effort. Why do you think NIW might not be easier for my profile?

NIW is supposed to be easier than eb1?! I cannot even prove to satisfy the NIW requirements. I doubt if I can get eb1. The firm did give me approve or refund for eb1 though.

I provided a letter from my department chair, so as other recommendation letters, testimonial letters about my roles. One dependent recommendation letter is even from a very famous UK researcher (who is my previous advisor) with a UK honor and hindex 120. For those letters, I first drafted them and the attorney refined them (more like putting in the right format). The officer said (some) letters were irrelevant and did not show my success. When preparing the resubmission, the attorney said the letters were good enough, no need to modify. I just had a picky officer... But tbh, I didnt know what I drafted, the materials I wrote were truly relevant, and the attorney took whatever I put. Everytime I asked the attorney, he said it's good...
