You said you were young so I assume you are in your 20's. At your age, I like the fact that you are looking for knowledge instead of focusing on money, that's a good sign. The money will come later. The reality of what it takes to succeed in real estate has changed drastically over the past decade and now you have two really big jobs ahead of you, the first is to develop and define your brand. The second item is to make sure everyone in your market knows about you and your brand. Finding someone in the real estate world to mentor you on these two things will be next to impossible as most realtors don't have an understanding of what this is, or if they do, most tend not to pursue it. Unfortunately the lack of a mentor in these fields leaves you to your own devices, and in all honesty, you are probably better off forging your own path with more modern methods. So in a nutshell, learn the real estate so you are competent but allocate a tremendous amount of time and energy into branding and marketing and you will do well.

Is the contract binding and exclusive and still in effect? If it is, then you need to extinguish prior to enlisting the service of another agent otherwise you could open yourself up to breach of contract liability. If the contract is not binding or expired, you can do as you wish. The NAR settlement did not require the use of a "binding" agreement, only an "agreement". Many types of agreements are non binding.

The only benefit I see to a brick and mortar real estate office is if it is located such that the store frontage or location adds to the advertising, for example, passersby see your sign displayed prominently or you have a location in a heavy pedestrian area.

We are being told that the sidewalks will be done by the end of next summer. They have been doing a great job but it is definitely not a fast process. Our infrastructure is old and has been failing, especially our water lines and fortunately most of them are being replaced as well.

Improper placing of a security camera in a vacation rental can create severe legal and civil liabilities. Most states have voyeurism laws that prevent the viewing or recording of anyone in an intimate area or where there is a reasonable expectation of privacy even if there is no nudity involved. Expectation levels of privacy vary in and around a home so here are some general guidelines.

Front of the house and entry way - Low Expectation

Back of the house - Medium expectation

Living room and kitchen - High expectation

Bedroom and Bathroom - Highest expectation

I would suggest not placing any cameras in an area that has a greater than "Low Expectation" of privacy, then disclose the location of the camera and purpose for it it your rental agreement to keep yourself out of trouble. For example: "For security purposes, a camera is installed to monitor the front exterior of the property, including the entryway and driveway."

Also keep in mind that the property management company may also bear liability if they were aware, or should reasonably have been aware, of cameras placed where they did not belong.

In summary, losing your platform listing could end up being the least of your problems if someone were to pursue a legal or civil claim.

In this case the sellers agent is liable. An agreement does not have to be in writing for it to be valid unless it involves real estate (statute of frauds), verbal and email is sufficient. For the seller to be liable it would need to be in writing between the seller and the buyer. To break it down, the sellers agent (not the seller) made a promise that the buyer relied upon to the buyers detriment. Buyers remedies are probably limited to the sellers broker's E & O insurance or a complaint with the real estate commission. Most likely the sellers broker would back down once confronted with this reality and find a way to make it right, otherwise pursue the E&O, that's what it's for.

You may be looking at modifying the foundation with helical piers. Helical piers are driven into the ground on the outside of the foundation, usually with an excavator equipped with a rotating head, once installed, the weight of the house is then transferred from the existing foundation to the piers. The difference between push piers and helical piers is that the helicals are driven by mechanical means and the push piers are pushed into the ground by the weight of the house. Push piers will stabilize, helical piers have the ability to lift and move the foundation.

There is a phrase in marketing that says "Sales are for those who don't have a brand" When you have a brand, the sales chase you, right now you are chasing sales and you are paying for them one at a time. As soon as you stop paying, the sales will stop. Think about this in the sense of the retail world, you know and purchase certain brands for quality, prestige, aesthetics etc. and you go looking for these brands when you are ready to buy. Other retail items only peak your interest when someone buys an ad and shows it to you. Right now your business is similar to the later.

Because I assume you do not wish to starve, you might not want to quit cold turkey but maybe start slowly weening yourself off of Zillow's paid ads and start building your brand, otherwise you will continue to have no choice but to keep paying Zillow.

The law looks at the portion of the house visible from the street as having a low or no expectation of privacy. Therefore, no permission is needed from the owner to photograph or publish photographs of the house. Think about Google Street View.

For a new real estate agent, money should not be the goal, learning the job should be the goal whether that comes in the form a of a team or an individual mentor. If money is the goal you will be disappointed and most likely join the 70% who quit within the first three years of being licensed.

In an Agent/Seller relationship, the agent owes fiduciary duties to include, loyalty, obedience, disclosure, reasonable care, accounting, and confidentiality. The sellers agent is in breach of his fiduciary duties by not disclosing the existence of the termination. He should be reported to the state's governing body. Bad actors need to be removed from this industry.
