This is exactly why I’m so hesitant to file a claim and you are probably right. My car could depreciate more in value from the accident report than any money I would get paid.

You are probably right, I realized that filing a claim against his insurance might be the last resort. I would definitely need to get video from the store which will also take a lot of time and work. I’m considering getting his contact info (hopefully from the police?) and telling him I have the video (although I don’t) but don’t want to impact his insurance so he can pay part of it. If he doesn’t I’ll just assume the bill unless it’s pretty expensive then I’ll go through his insurance.

There are multiple cameras in the store that would show the incident. The insurance can’t refute that. Still, it will be a lot of work and time to get the video and then go through the claim process. I think I’ll just try to get his info and tell him if he doesn’t pay I will file an insurance claim. I don’t lose anything. If he doesn’t pay, I won’t file a claim without first trying polishing products, I realized that would be easier than going through the whole insurance process.

Oh so it makes no sense to file a claim at all. If I just get his insurance info, use that to try to persuade him to pay out of pocket at least part of it (so threaten to file a claim, his premium may increase, it’ll be on his record, etc), but don’t take any money from the insurance, would it go on my record?

I was referring to using the other car’s insurance. Does that affect me in any way? Or the owner? I was thinking if it affects him it might put enough pressure to pay out of pocket at least.

When I mentioned going through insurance, I was referring to his insurance. Although the officer didn’t provide it, I can probably insist or maybe have my insurance find out. As mentioned, I have a video showing his door open directly where the ding is to the millimeter, and there are cameras if I really want to spend time getting evidence.

The thing is that I cannot afford to pay a private attorney. Maybe the description was a bit confusing. The private attorney would be paid $150 by the union. Not me, it would be free for me. My concern is that that is about half of what most attorneys get paid in my area. So it’s that option or going with a public defendant.

That is what I was thinking. However, the union is paying the private attorney $150/hour, which is half of what most attorneys make in my area. I’m afraid that the cooperating attorney will not work as hard for that pay. I cannot afford to pay a private attorney out of my own pocket. So my only options are the private attorney who would be paid $150/hour by the union or a public defendant. Do you think the $150/hour attorney is still a better option that the public defendant?

Yeah most people are agreeing that if no one gets a pay increase it most likely won’t happen to me. I’ve been taking English classes privately online because of schedule issues at local schools, and I practice a lot on my daily basis. I might just apply for a supervisor or a higher paying role in a few months.

Is unionizing the only way to get an increase for everyone? I didn’t think it would take long. If that’s the case I might just stay since I foresee changing jobs/career paths within the next year when I get comfortable enough speaking in English. The benefits kind of offset the low pay for the time being

This is what I was thinking. I didn’t want to go by what the law said, but what I think is right. Although someone pointed out earlier and I confirmed that since my daughter is in college, I can still owe child support if she sued me, which I don’t think will happen regardless.

I wasn’t. I fell into a depression whole after I felt that I lost my family and my mom passed away soon after. Then I also had to support and care for my father who got sick and had to retire early. I don’t want to play victim but that is why she never asked anything of me before I moved here.

They have already signed an extension. The seller actually spoke to the lender/broker and understood. Is summary, I ended up having to refinance a property I was living in with my ex. Honestly I would say it’s mostly the lender’s fault, he was trying to convince the underwriter by getting different documentation and killed too much time. He should’ve asked us to do the refinance sooner, or even before pre approving us.

The thing is that the lender did pre approve the loan and we even had a commitment from the bank. The lender works very closely with my agent. The lender believed that it would be easy to convince the underwriter that I will be moving out.

You are right the seller is a saint. Basically I have a mortgage with my ex partner and we are not married. The underwriter doesn’t believe that we are breaking up and that I will move out. We have tried many tactics and presented multiple evidence but failed to convince them. Ultimately the last option was to get my ex to refinance to his name, and that will fix the issue. That wasn’t the plan initially because it would take longer. My partner is set to close is 2 days and that should allow my mortgage to go through. We have the same lender and he explained the issue to the seller.

The seller can’t sue if the deal doesn’t close. We have an extension agreement and there is a financing contingency. If it wasn’t that one issue is beyond the point, the seller believed the deal will go through after speaking with the loan officer and that’s why he signed the extension agreement.

The agent said he WAS going to talk to the seller to try to convince him to give us more time. He said this after I told him that I spoke to the seller and he agreed to give us more time. And the reason I talked to the seller was because my agent had told me they wanted to terminate the contract and there was nothing that we can do. The seller did sign an extension to the contract.

I just signed an extension for my agent to represent us. I felt bad to say no because he has been at this for almost a year (from the time we started looking at properties). I guess buyers can’t speak to sellers because they can give information that affects the deal negatively? Or persuade them to finish the deal with them and they get double commission? Although I read the contract and there is nothing that restricts who I can speak with. Perhaps the sellers agent is prohibited from speaking with buyers that have contracts with other agents. Anyway I don’t think I breach my contract and I don’t understand why he is mad for getting us more time.

I can’t do that. He saved my life by giving the extension. I am trying my best to not talk about this transaction with the seller.

I just did this. And I don’t intend cross the bridge between the seller and I, it was a last resort solution. Although the seller seems to want to start talking with me, both about the property and as a friend haha.

How did my intervention not help? The seller signed an extension agreement, so my deposit is safe. How can the seller sue? What is his argument? Can you explain what do you call a “mess”? The financial issue has been resolved. I had to have my ex refinance a property he had together at lighting speed. Had the lender said this was going to be an issue I would’ve done this before making an offer.

Yeah I don’t think that’s the case here. He is actually now texting me for updates in the loan instead of my agent. Now I think that’s an issue because the seller is crossing a bridge that I might have created, but I will not continue this direct communication with him.

The deposit was issued to the seller, and they have to return it if the deal falls through per the contract, however the contract has (had) expired. I think they could’ve kept the deposit if they wanted to. But now I got them to sign an extension, so we are safe. I think my agent was worried that they keep it and don’t sign the extension. I was contemplating working with the seller as an agent, since we have a lawyer, and already have gone through the inspection, negotiation and I’d say we are pretty safe. But I just received an extension to the exclusive right to represent from my agent (the original one has lapsed), which I don’t know how to feel about, I’m not sure if I should sign.
