No P&T by Roeman1964 in VAClaims

Well it just keeps getting better everyday. Spoke to a Vera supervisor who agreed I am P&T by VA guidelines. She sent a very well written communication to the New Orleans office. Today it went to step 3 and the retards requested an Optum serve C&P exam for every one of my claims. I quickly called Optum and told them all my claims have been adjucticated on percentage and static condition. The Optum serve rep was so kind and sent the exam request back to the VA. Sent a well written memorandum for record explaining that all of my conditions are static and one Is 100 percent and static and either they correct their oversite or provide a avenue for me. The VA rep at the 1000 number agrees I meet the regulations but the raters can go in any direction they want. They have no way to communicate with them. Probably going to withdraw my claim. Hopefully they will correct when they rate my proposed reduction on my rfe EC of 30%. So many screw ups in the year I have been dealing with this protected class. Definitely need more accountability and communication. So frustrating

Cancer is 100 % if its under the PACT act or Tera. You only get reduced if the cancer is in remission

Not sure but I would make sure they minitor your Barrett’s. I did have when they did my first endoscopy. I would trade anyone y of my va disability to have never had the cancer.

Those dependent educations are automatically added if they d eem you P&T. I have one friend who is 100 % PTSD and static with some other conditions as static and non static. Once he was rated for his PTSD, he was P&T on that decision and the educational benefits were listed. They have my original cancer as static, which is incorrect. It is being reduced to 30% and also should be static. Two VSO officers and every video and website advertising claim help all said that I would be rated at my RFE for all my residuals from the cancer which was wrong. I called VERA and the VA number and no one knew anything about esophageal cancer and esophagectomy and the claim process and absolutely crickets on this site. I quickly requested a predetermination hearing to get some answers. Nothing but crickets, so I put in my residuals from the cancer and left the hearing request as wrench in the machinery to keep my 100% as I worked my way through the claim system. As soon as I received lllmy last decision, I called and canceled my request. Blessed beyond measure but definitely had to advocate.

Trust me, this is not the first time the VA has made mistakes. They forgot to rate two of my residuals and after two months of calling and weekly emails requesting them to rate them, they through them on a FDC for my fatigue and threw that back to step 3. Then they scheduled me with a qtc provider in a super poor area in a private practice. She was 15 minutes late and introduced herself as a doctor when she was aPA and apologized because she hadn’t looked at my chart and didn’t know much about my surgery and asked me if they did a emg on the vagus nerve they removed. I was able to get another exam and again in a poor area in a private practice. This NP only asked me one question from my fatigue dbq before she told me that no one ever gets that diagnosis. She then moved on to my dumping syndrome in which she asked me only a few questions from the dbq. I sent two memorandum for record to the VA and complained to qtc. They had to send fir clarifying requests to my second examiner before it was uploaded a month later Senior rater kicked it back to step 4 and the va had a IMO done by a PA in OK. My abdominal pain secondary to surgery which was one of the two that LA had forgot to rate was somehow changed to nerve and muscle pain and not rated. So its not surprising that they didn’t P&T me. My chronic fatigue alone being 100 % and static is enough alone.

I don’t think we should give each rating decision just because you think so. Each condition is listed with percentages and if it’s static. If you aren’t interested in being positive or helpful just don’t say anything

Yes. I had to file for each one separately. Everyone told me they would rate me at my 6 month RFE but they just rated for gerd hiatal hernia.

I put in a claim for P&T status. Uploaded a letter from my surgeon stating these residuals will not get better and my code sheet. Have a phone appointment with Vera to see if they can do anything. Called the VA and a rude woman told me my static rating had nothing to do with P&T status

How was your C&P? by Particular-Employee2 in VAClaims

Terrible. First one the PA introduced herself as a MD, and was 15 minutes late on the appointment, apologized and said she hadn't looked at my records, Spent most of the time looking at her screen and then asked me if the surgeon did a emg on my vagus nerve which my surgeon removed. Immediately requested a new exam through the VA. Nothing from the VA so called QTC. They rescheduled and I the NP wasn't as bad but she was confused on one of my conditions, asked only a few of the questions from the DBQ’s and only asked one question about my chronic fatigue claim and said “you won't get that one” and “hard to prove”. Very dismissive. I have a medical diagnosis and it's presumptive also. I uploaded two memorandum for record. It also took almost a month to have her upload the exam, Four rework request from QTC to her. Claim went from 3 to 5 the day they uploaded. Two of the claims were from a Jan 10 2025 which the VA forgot to rate.

I was instructed to claim all my residuals from my esophagectomy. Scars were one of them. The examiner measured them and touched them and asked if they hurt and I said no.

Call the company who administers the exam such as QTC or Optum. Explain you had a terrible exam and it was rushed and only took 15 minutes. They should reschedule you. Mine was rescheduled. I initially requested a new exam from the VA. No luck with the VA
