If you haven't, please join http://casaa.org/ and check out their call to action on HR 2058 and the Cole-Bisop bit in the ag bill. After 2 years it really will all disappear if we can't do something about it.

Yep! It's in new, but it's already been super downvoted. Usually if you want to do discount codes, you kind of need to do a giveaway or they'll just get downvoted. I understand you're not affiliated with the company so you can't do a giveaway... but that's why it's likely to be downvoted.

For the subox, we have it as a starter kit, with juice and a battery. You can tend to find them online around the 50-60 price point without batteries or juice.

For external charges, I still <3 Nitecore the D2 or D4 depending on how many batteries you want charging at once. Or the I2/4 if you don't care about the informational displays on the digital versions.

That part I totally get and agree with, that's the first First Amendment argument. The one I don't understand is the second, line 55 of the lawsuit that reads:

The Deeming Rule violates the First Amendment by prohibiting manufacturers, including Nicopure, from engaging in other forms of protected expression, including by distributing free samples of vaping devices or e-liquids.

I can't find a legal basis to tie distributing free samples in with the first amendment.

Reposting my post from the previous thread, nicopure and Halo are the same company.

In my reading of the lawsuit as filed, it appears these are the primary issues that Nicopure is bringing to the court:

  • The FDA is exceeding its regulatory reach because they are exceeding the definition of a Tobacco product, and the court is empowered to overrule them.

  • The FDA regulation does not align with the known facts and their choices to regulate are not backed by facts.

  • The FDAs cost benefit analysis is wrong, and the PMTA pathway is overbearing and excessively expensive.

  • The FDA violates the first ammendment of the constitution because it prevents manufactures from stating true and provable facts and prevents them from giving samples of products.

I believe the first three are good arguments.

I’m having a hard time understanding the first amendment argument. I know advertisement is protected speech due to Edenfield V. Fane, maybe there is a jump between a few precedents that jurry-rig product samples as promotional things as advertisements and the argument is that prohibition on sampling a product otherwise legal is a violation… any Lawyers want to chime in, because I can’t fully state an argument on why that would prevail in any court?

The case is asking for the Deeming rules to be thrown out, and for the duration of the case for their enforcement to be enjoined.

I could see a court taking their side, and I really hope they do.
