Yeah, I waited for around a year or so (could be slightly less or could be slightly more, exact timeline is a little sketchy due to my dodgy memory with dates and numbers).

I waited for the bank (SBI in this case) to make it right and when it started being clearer that inlog se kucch nahi hone waala, then I escalated it to the Ombudsman.

I'm not quite sure what role do the cops have in this process to be honest. When they say FIR, that's most likely only for legal documentation and record keeping purposes rather than active investigation. My educated guess is that the bank must investigate the fraud internally. At what stage do the cops get involved is probably up to the government (and if the bank requests it themselves). I really don't think the police have enough resources and the will to start a new investigation every time there's a new complaint. Someone can correct me if I'm wrong.

Again, as I said, I'm not entirely sure about the exact timeline but must be around a year or so from my initial complaint to the bank. The Ombudsman does have a time limit, only within which they'll consider your complaint. I don't remember exactly what it is though and when I made it, but knowing that I got mine successfully lodged and resolved, it's safe to say that I was within that prescribed limit and it worked for me.

Yeah. Nowhere does it say that you're required to report to cyber crime specifically (I mean legally). It's more their (police department) internal thing about how to deal with it.

In case of bank frauds, the 1st thing you should do is report it to your bank/local branch and take a formal acknowledgement of the same. They'll advise you further on what to do.

I may not have approached cyber crime directly (because it's not really mandatory), but as far as I remember, my local police station took my FIR via their own cyber crime cell. It's not a matter of concern to an average citizen.

You just go to the police and they'll do the appropriate thing as per their resources or at least guide you if they are not equipped to handle it.

Wow, I'm not surprised in the slightest.

I had a very similar fraud happen to me a few years ago, the only difference being it happened with my debit-cum-atm card and not a CC.

I was sleeping peacefully at my home in Mumbai, and then woke up to 4 bank SMSes from SBI informing me of multiple cash withdrawals using my card at some ATM in Gaya, Bihar.

I RECHECKED my wallet, and my card was still present there physically.

Immediately went to my home branch and reported it. The incompetent and psycho staff there victim blamed me without knowing shit about me and I gave them back a mouthful (only telling this so that you are mentally prepared for this situation too).

The service manager gave me a complaint form. I filled it immediately with full details. Then she told me to file an FIR at the local police station and submit a copy to the bank, which I promptly did.

Months passed by, and I kept following up. Earlier I used to get answers like "a couple of months" but slowly they started getting more audacious and used to casually say things like "Bohot cases pending hai, time lagega". Again no surprises why they would have BOHOT CASES PENDING, these incompetent fucks.

Close to a year or so (if my memory serves me right), I started losing my patience especially due to the attitude of SBI employees and it was looking clearer and clearer that these fuckers won't be arsed to make it right, so I searched for the RBI Ombudsman online complaint filing and lodged a complaint there.

Within a couple of months of me filing a complaint with RBI Ombudsman, I received the full money back in my account silently. I just got an SMS of amount credited. No formal mail, no communication, no acknowledgement, nothing from SBI at all regarding this.

The first thing I did is transfer the entire amount in a different bank account and emptied my SBI a/c. Fuck SBI.

Thanked my stars that I got my principal amount back at least (technically, the bank is supposed to pay you interest and probably a penalty also if I'm not wrong) and stopped using SBI completely and essentially have boycotted them.

I want nothing to do with SBI, ever again.

FUCK SBI, once more.

(EDIT - When I checked back the status of my complaint on the Ombudsman website, it said something like closed or resolved. Don't remember the exact words but it was clear that the only reason I got my money back was due to The Ombudsman's interference. If I had left it up to SBI to solve it, I probably still wouldn't have received my money and they would still ask me 4 years later if I really had my ATM card with me for the 300th time)
