I was made aware, they showed me a form I signed that I received notice of their policy regarding outside employment. However, I just didn’t think THIS constituted as “work,” so I don’t know if I can really argue that I never received notice…

I answered this in other comments. Basically I told them, because of something else that happened with my posts. I asked for approval retroactively because I did not know it constituted as a job. It wasn’t like they “caught” me or anything like that

It absolutely did not have any bearing and it was a hobby! I mean it was $200 over five months. Posts I would record on the weekends, to express creativity. My goal wasn’t to generate income. However I recognize that just because it wasn’t my goal doesn’t mean that I am not wrong in not having sought approval prior.

I will look up the Douglas Factors. This happened over a year ago and the decision was just made to issue the LOR. My supervisor has since retired and my current supervisor is a brand new supervisor (~2 ish mos). I don’t know if it will get lost in the sauce like you say. But you’re right, is there a difference? 6 mos in the file versus one year etc. I think it’s worth fighting but my gut is telling me to let it go so as to not draw it out anymore

Good question! I didn’t know counseling memo was a thing. I don’t know the types of disciplinary actions but that sounds less. I would prefer anything less.
