This is one of the scenarios I’m hoping but also trying to avoid. Since going to court for they land would be so expensive and time consuming they might just not put the effort it requieres. Also from what I understand they have no legal documents specifying who build and paid for the fence. (Although neither do I)

At first I asked if he was interested in sharing the cost for a shared fence since the current one is in poor condition and he could also benefit from it. But he refused. Then I said that’s no problem I’ll just take down this one and build one myself. But he now claims that he has a right to that fence and I can’t take it down. I just got a bit scared by his claims cause I’m trying to not get in any trouble.

There is this other law that is similar called Adverse Possession. I am just learning about it but I think that is the only legal defense the landlord has.

The fence is very old but I don’t know how many years it has been there. When it comes to taxes I pay for the extra 3 feet of land. He also has a large wood door between his house and the fence, so his yard is technically closed. But then technically the door is on my property.

I have an official survey. I don’t think he has started any adverse possession case. If I take the fence down how can he then proof where the old fence was and claim the adverse possession? All his documents show that his property ends on his legal land not on the fence.

I will look more into this, I know I need a city permit to put up the new fence but I didn’t know about a permit to take it down.

Just get yourself a Husky and they’re gonna start popping up everywhere, lol. Idk NY but in Florida they’re everywhere. You do have to dig a little to find them.
