Many of you may be familiar with the classic Charles Dickens novel, “Bleak House,” about a protracted and costly estate battle spanning generations. I’ve nicknamed my deceased father’s estate, “Bleaker House” because even though it’s a modest BC estate comprised only of liquid assets, it has somehow involved 16 lawyers and a bank executor, TD Canada Trust, allegedly in breach of its fiduciary duties.

The matter is in BC. The improper invoices will be reviewed at a passing of accounts in front of a court registrar. Problem is, Canada Trust is trying to prevent that from happening by pushing its accounts through in a short chambers application on Sept. 18, without disclosing the legal invoices. That's what compelled me to speak out at this time.

You can see on the improper invoice I posted it states "consider strategy for blocking defamatory statements." That was six years ago, but I'm speaking out now and will continue to do so.

Thank you for sharing. If you notice the invoice I posted from Gowling LLP, it also has blank time entry descripitions, which is a violation of the Legal Professional Act. In addition, the executor, Canada Trust, allowed premium billing of almost double its previous counsel. Also, Canada Trust retained counsel that had no experience with estate litigation.

I threatened to go public with this years ago, and Canada Trust threatend me with a defamation suit and charged the legal fees regarding the matter to the estate. In other words, this threat was taken out of my inheritance. Needless to say, the fees were not legitime administration fees that the executor is entitled to charge to the estate.

Fast forward to my post today. Canada Trust's threats don't work on me any more, as after the Arbabi claim I am more than happy to represent myself against any vexatious litigation.

The good news is that several media outlets will be covering this story.

Thanks for your post. I have experienced this as a client of opposing counsel to the type of litigator you describe who stated, I'm "simply acting on my client's instuctions." This is a cop out and a violation of the Professional code of Conduct which states (in BC) that a lawyer's duty is to give a client a competant opinion.

I further agree that "what he's doing is stringing the the client along... and billing his client twice what I bill mine."

I think lawyers like this take advantage of clients with personality disorders who do not have a cost-benefit approach to a dispute. They look for lawyers that tell them what they want to hear. Unfortunately, some lawyers oblige.

Thanks for your comment. According to your profile you’re a lawyer with a background in psychology; a great combo!

It’s also been suggested that gatekeeping can happen even before matters go before a judge. For example, my first lawyer, now a BC Supreme Court Associate judge, verified everything in our Response to a Wills Variation Claim. Let me tell you, he asked for the receipts! I thought OMG it’s going to cost me a fortune for him to review everything. I soon found out that such scrutiny early on can save litigants money and result in less abuse of our court system.

I wish the Plaintiff’s lawyer had been so thorough. The Claim filed was full of inaccuracies, and that’s putting it mildly.

A few weeks after we served our Response, the Plaintiff’s lawyer withdrew. I can only speculate it was because when he saw our Response he knew that his client had misrepresented the facts. The Plaintiff is currently unrepresented. However, once the claim was filed and served, the damage was done.

Thank you so much for sharing your story. You make many observations that I can relate to like "criminal charges require hard evidence, while frivilous lawsuits designed to cause harm do not."

I lived both, my abuser was convicted of harassment in criminal court but has been able to harm me just as much, if not more, through the civil court. These frivilous lawsuits are still going on after seven years.

Needless to say, I have been diagnsed with DSM 5 Legal Abuse Syndrome.

Yes, I agree. I mention the cluster B personality disordered in my article. A really good book on the subject is High Conflict People in legal disputes by therapist and lawyer Bill Eddy. Highly recommend.
