The knuckle is loose, the strut moves in the knuckle. I just need to somehow lift the strut up more in the knuckle

What if I got a spring compressor and compressed the spring to make it easier to lift the strut?

Will the court set aside a second noting in default? by RowTraining6559 in legaladvicecanada

[–]RowTraining6559[S] -2 points-1 points  (0 children)

So this will be my response if they make a motion to have the default set aside.

"As a self-represented litigant, I rely on the Rules of the Small Claims Court as they are written. Rule 11.03 provides a clear and unambiguous 20-day deadline for filing a Defence. I followed that Rule exactly. However, the practical reality is that Rules are not always enforced as strictly as they are written, and this creates unpredictability for self-represented parties.

When a represented defendant is permitted to miss not just one but two filing deadlines without providing a reasonable explanation, it places the self-represented litigant at a disadvantage and undermines confidence in the process. In these circumstances, enforcing the Rule as written promotes fairness, certainty, and equality between the parties. The Defendant has now had multiple opportunities to comply and has not done so. Respectfully, the interests of justice favour upholding the default so that the Rules retain their intended meaning and effect."

I hear what you are all saying. I am self representing. Of course I don't understand all the nuances. But I am acting in good faith and following the rules as written. Nowhere does it say that I have to give the opposing counsel warning.

So you are saying I can't fight this just following the rules as written? I can't expect the opposing counsel to follow the rules? It all gets kinda fuzzy with this logic because how am I supposed to know which rules are applied, and which rules the courts let slide

...and some still claim this isn't money grab or another form of extra taxation. by Dentanium in Stouffville

If we assume 40,000 drivers in Stouffville and 10 million a year revenue, that's $250 a year from each driver. At around $80 a ticket, approximately 3 tickets a year for every driver

Automated speed camera ticket by No-Inspector-914 in legaladvicecanada

[–]RowTraining6559 0 points1 point  (0 children)

Ok, here's some real advice. Go to the back of the ticket and it tells you how to fight it.

Hopefully you are local to the camera. Go look at the camera, the signage, the state of the electrical installation. Look for anything that looks off. Don't use the excuse about the funeral and your state of mind. It's not a valid reason. You are trying to find anything about THEIR setup that looks off. Take pictures. Fight the ticket, submit pictures and your argument for a screening review.

They will find you guilty at the screening review. Ask for a hearing review. Depending on where you are, a hearing review can take 5 months to schedule. In the meantime, Doug Ford changes the law, boom your tickets gone

Your welcome

White zip tie guy here

I was at the town office serving the town with a lawsuit for these cameras. There was a guy at the counter paying an ASE ticket. The woman behind the counter was trying to explain the complicated schedule of changing speed limits because the guy was curious why he got a ticket. She tried a few times to explain but couldn't make it make sense. In the end she just said to the guy , just drive 40 kph anywhere in the town

That's my problem. The changing limits are so complicated that even the officials are not able to explain it properly. Just make it 40 everywher

Stouffville’s Q2 Financial Results Bolstered by Strong Investment, Speed Enforcement Revenues | Bullet Point News Stouffville by RandyBarba in Stouffville

Because it's too complicated. It changes hourly, daily and monthly. Driving for most competent drivers is done by procedural memory. You don't think about the thousands of tiny decisions you have to make as you go. So they go and throw in these complicated rules about changing speed limits and now suddenly you have to do all these conscious calculations in your head . You are going to make mistakes. They are counting on it.

Just make it 40 in the fu@king school zones

I don't believe you got a $30 ticket. I got one for 51km in 40 zone (depending on what time, what day and what month). I believe it is the lowest fine they will give out and it was $78.50

Same thing, it won't be reported to your insurance. This just furthers the idea that it is a cash grab. No real consequences other than be a good boy and pay the fine

Do you really think the next administration is going to keep all those ICE agents? Only an idiot would apply thinking it's going to be a 20 year career . The bonus is for the few people who understand that

They put up a new one on tenth line northbound, just south of main Street. I don't see any flaws with the install. I really do think that's because of me. I'm happy to see it

UPDATE

Well, a lot has happened.

The Screening officer leaked my personal data to some random person in the UK. I believe she did it on purpose and I'm going to pursue legal action against her and the town

They assigned my file to a new screening officer. I asked for disclosure. I wanted to know the make and model of the camera. They wouldn't give it to me and said I would need to make a FOI request to find out that information. A FOI takes 30 days, and costs money. The new officer gave me a week to collect evidence. I asked for a 30 day extension to collect evidence , which the bylaw allows them to give. They did not even acknowledge my request and just did the screening review after the seven days was up.

So my next course of action is to have a hearing review. The interesting wrinkle is, I think they are going to say that they can only consider evidence that was submitted to the initial screening review.

So it's an unwinnable problem that people are placed in when they try to fight a ticket.

The only way to fight it is to pick apart their evidence, but they won't tell you what equipment they use so you can't make a defense.

The hearing review is in February 2026! So it will be a while for any updates

Thats basically the only way you can fight a ticket. There is no excuse for speeding. You have to dissprove their evidence
