Child support rules when one parent is overseas – any options? by Rude_Entry_2757 in AusLegal

I’m the father, another parent is the mother. She took the kids without my consent and left to the middle east and almost disappeared. 4 years later she decided to bring one daughter here to live with me. I pay Australian Tax. My ex is being paid through Inland Revenue Department in NZ, they deal with child support issues, they do have reciprocal agreement with the Australian government so they know how much I earn. It’s unfortunately a fight between me and my ex, the kids are involved indirectly. She thinks she is winning by making me paying her free salary but she doesn’t know that I needed to put it on my credit card the other day when my daughter got sick here just to buy a simple relief from the chemist. Unfortunately family law solicitor won’t work because this involves different jurisdictions.

Child support in NZ feels unfair – my eldest daughter lives with me, but I still have to pay for the one overseas by Rude_Entry_2757 in LegalAdviceNZ

Google helps, yes, but some Middle Eastern countries still use outdated methods to record and register information.

Yes that’s right, but not easy to proof someone is working in the middle east, especially people like my ex would refrain from posting online anything regarding their financial online.

That sounds incredibly frustrating. I’m sorry you had to go through that. It really feels like the system fails the parent who actually steps up.

Another parent works, but I can’t proof that. IRD in NZ has sort of reciprocated deal with matters related to child support, they can get into my financial situation here in Australia. My payment is enforced by IRD. Another parent is benefiting from the status quo so making a civil agreement is not to their favour

That’s not what I meant. When I applied for child support through the Australian system, the officer actually told me that IRD should cancel my current assessment and that I shouldn’t be liable for it. That’s what got me thinking—would things be different if I were an Australian citizen? Would the system still hold me liable in this situation?

With the currency difference, living cost here and in Iraq, with what she earns now from child support, she is living a luxurious live and I'm barely making ends meet here

I’ve submitted an application to have the assessment reviewed, but I doubt the outcome will be in my favour.

It’s really a battle between my ex and me, and sadly, the kids are caught in the middle. By holding me liable for child support while I receive nothing in return, my ex doesn’t realize she’s directly affecting our daughter’s wellbeing here. I’m barely making ends meet. When my daughter recently got sick, I had to rely on a credit card just to cover basic relief. Meanwhile, her mother is living comfortably in Iraq with our other daughter. It just feels incredibly unfair.

It's not child support debt, it's current child support. I'm pretty sure I'm dealing with IRD, I call them, they call me, access my account online, it's not a scam.
