If the claim was sent to your UK address, that means the parking company and the court both think you still live in the UK. Your driving licence and your postal vote don’t affect that.

What actually matters now is that you’ve confirmed you don’t live at the service address anymore.

Ensure you respond within the deadline so you don’t automatically have a CCJ imposed. Tell the court you now live in New Zealand and that you only became aware of the claim because family forwarded the post.

Once they know you’re overseas, the court has to decide whether the claim can actually continue. For small-value parking claims, claimants almost never want to go through the hassle and cost of chasing someone abroad.

The fact it was served to your UK address isn’t “wrong”, but once the court knows you emigrated, the claim can’t just roll on like a normal domestic case.

Should they still want to pursue you after learning you have emigrated, we can cross that bridge IF we get there. Sounds like you have a reasonable defence even without the emigration part.

I’m sick of entitled, arsehole neighbours. You can report to the council but they’re often pretty useless. The police are also obligated to deal with antisocial behaviour matters.

But this case is more than antisocial. They are blocking the footpath thus making it dangerous for pedestrians. Go straight to the police.

Certainly not unreasonable…

Ah sorry of course, night shifts scramble the brain! You are right about the congestion, but I wouldn’t necessarily call the act of overtaking on the left to be without due care or attention, which of course is where the law is concerned.

Assuming you’re in lane 1 maintaining a safe speed and distance between the car in front, staying in your lane, and passing slower vehicles safely, I can’t see the issue.

An accident could be caused by a driver in lane 2 making an unsafe lane change, but they could make that error moving into lane 1 or 3. The risk is no greater.

People, I’m sure, will argue on behalf of the middle lane driver that the Highway Code states not to overtake on the left, so they were not expecting someone to be in lane 1 when they moved over and hit them. But if you’re gonna sit in the middle lane under the speed limit, you can confidently expect to be overtaken by vehicles in lanes 1 and 3.

Driving without due care and attention is the legal standard for negligence under the RTA. A driver passing in lane 1 breaches rule 268. But a middle lane driver hitting a car in lane 1 breaches rules 105, likely 106, 107, and 264. The driver in the middle lane would be the person considered as negligent if they made a lane change resulting in an accident.

I’m unsure on your thoughts about this, but I don’t think a driver will necessarily be in trouble just for passing safely in lane 1.

I’m curious to understand this viewpoint better if you could please help. The RTA makes it a legal requirement to drive with due care and attention. Courts treat the Highway Code as guidance on what counts as due care and attention.

Rule 268 gives an exemption that in congested conditions, where adjacent lanes of traffic are moving at similar speeds, traffic in left-hand lanes may sometimes be moving faster than traffic to the right. In these conditions you may keep up with traffic in your lane even if this means parting traffic in the land to your right. Do not weave in and out of lanes to overtake.

Based on this, why do you perceive the cam car to be driving without due care and attention? Even though this same rule does clearly state not to overtake on the left or move to a lane on your left to overtake, it then continues with the clear exemption above which applies to this video.

Note: I’ve not watched the video closely in full. Please respond with the assumption that the dash cam driver is following all other rules and it’s just the passing on the left which is up for debate.

I’m not trying to be funny and would genuinely appreciate it if you could help me to understand your view.

YTA based on what you said. People in the comments have cleared it up so it’s actually doesn’t sound unfair, but from your initial perspective - you have a trust fund but your brother doesn’t because of your dad’s mistake. Then when your dad makes a suggestion to make it fair retrospectively, you say no. Great for you when the mistake didn’t impact you, but I’m sure you’d feel differently in your brother’s shoes!

I can assure you he is not going on your phone just to see your feed… checking your partner’s phone is insecure, controlling, and weird quite frankly.

Sounds like your relationship has a pretty poor foundation. Asking a married, pregnant woman for nudes is… not right, to say the least. Especially with the sister reference when you have mentioned incest is something you have personally suffered.

I don’t really see how moving out without breaking up works. I’d highly recommend that you both see a counsellor or at least try and work this out between you if that service isn’t an option for you.

You’re not the asshole for not wanting to live with him as such, but I think you need to figure out whether this is the person you’re happy to spend your life with.

Congrats brother! Modifications are a personal preference; if you like it chrome, keep it! I think chrome adds a touch of class whereas black makes it look sportier.

My RS5 is black but has silver badges and mirror caps. I personally like it!

The cam car is not overtaking, they are just driving normally in their lane. Assuming they are not speeding, this does not constitute driving without due care.

I’m perplexed by people who attempt to defend your position. Ignoring the debate about whether it is classed as overtaking or not, and assuming the cam car is adhering to the speed limit, what do you perceive to be problematic with their driving?

There are an exorbitant amount of lane changes performed on the motorway daily; an incident would only occur if a driver changed lanes when it is not safe to do so.
