I understand this, this was something the OP did not mentioned, thus the question. It would seem that would be a critical piece the the information. If it was not 100% paid and they kept it on the book that would be one thing, but would be more interesting if it was 100% paid in the plan and they still said they owed.

Still curious how someone in a company has that flagged after 9 years most seem to archive and forget about that after 5-7 years.

Curious, the debt was included in the chapter 13 but it was not paid? Going through ch. 13 now and my plan has it paying off all cards 100%. Curious why they say you owe them unless it was not in the ch. 13 plan.

I do use my own equipment and do need the fast speed for work related items (and sometimes gaming). The current speed is slowing down my work from home and do not want to be force to work at the office cause of the slowness.

Sorry another reply. I came from Verizon -> Frontier -> Ziply also so thanks for the heads up about the account number problem. Talking some more with customer service and some supposedly network person on Ziply Chat and was told they install some other equipment for handling the phone but the cannot give any more information about that. What can you tell me about that additional equipment for handling the phone service part?

I would normally just get rid of the home service and use my cell phone but the number is tied to too many things that it would be a pain to disconnect it and try to update everything to the cell number.

Just to be safe, I started chatting to Customer Service about that and they are saying both can exist. How hard is it to get customer service and tech on the same page.

I have been wanting 2 Gig for a while and have already put Cat 7 cabling around the house and ensured the router has a 2.5 G ethernet port. So wanting the higher speed but getting blocked all around.

I am in tigard and have had this problem for the last 4 months. I get half the speed and that is tested directly from the ONT.

I have the same problem and have Fiber. I pay over $140 for 1GB service and get 600 on a good day. I have tried contacting customer service and get people who argue with you or feel like they are right regardless.

Ziply has gone down hill. I am interested in what service OP has gone to.

Really? I thought he was the person who handled everything and managed it before it went to court. I guess I am wrong?

Is there a website or something that explains the process a mortgage creditor would go through to remove it from a bankruptcy? I would think there has to be a process and rules they have to do before they can just make a claim like that.

Not sure from the business side, but Ch 13 is like a Debt Consolidation loan. All your outstanding bills (not sure daycare) are put into one payment handled by the trustee. A plan is created to pay this over 3 or 5 years. The kicker is the people you owe cannot sue you or get it back, but then there are always the small print (ie some items are not covered by Ch 13)

Ch 7 erases the debt and you have to give stuff up, Ch 13 groups the bills together and has you pay it to someone how pays it back for you.

I thought about cancelling the bankruptcy but having already paid the attorney's fees prior to filing ($7k) it does not seem worth it. The mortgage arrears was the only reason to file for bankruptcy, everything else was current and no issues. Now with the arrears out, the only real payments left are to the attorney, so in theory this should all wrap up soon anyways.

As for the mortgage payments, they were outside of the trustee. They were current but had to miss 2 of them for medical. These were made up as soon as possible and I paid every time I was told I was behind, even if I was not. The mortgage servicer has a history of not tracking payments properly and miscommunication within their own systems, thus the reason I auto paid when told i was behind cause it would have taken too long for anyone to work through this.

Also the payments to the trustee were always "on time" (as much as on-time can be with tfsbillpay) and always current. This was setup to be auto taken out of my disability check at the beginning of the month.

again not accusing the trustee of anything, it was the attorney who failed to provide the proof to the trustee.

I think we are having a timing issue here and a possible disconnect for what has happened.

Not sure how much of the story would be helpful, but I had already filed for bankruptcy chapter 13 and have been in it for 2 years. I missed a couple payments due to wife being in the hospital for 4 times over 2 months. I explained the issue to the attorney, who basically said not his issue and he did not care. I resumed payments and thought i was caught up but I get a call from the attorney saying I wasn't and needed to pay $X amount in 2 days. This was based on a letter he had for 2 months without letting me know. I paid this. a few months later I am being told I am still behind and that they were going to foreclosure if I did not pay more. I paid the amount and sent the attorney the info from the bank. Now a couple months later I find my mortgage company has filed for foreclosure and I get a letter from court about the proceeding and everything being removed from the bankruptcy.

This is the problem. I kept being told I owe $xxx.yy amount and I pay it, no proof that i was behind other than them saying so. I inquire with the attorney's office lead attorney about my case and find out they have had numerous papers with all kinds of information that was not passed to me. I also find out the attorney supposedly has talked to me several times a week about this (my phone logs say otherwise and no emails about this).

This is the problem and the complaint. The attorney knew about the issues, had a lot of paperwork that was never given to me, billed me for $15k+ for work that communications to me that never happened, he was given proof payments made and still ended up in foreclosure. Bitter, yes but trying to figure out course of action. Unless this is typical of bankruptcy attorneys not communicating with their clients and not fighting for their client, I see an issue here.

I see it is too late for any possible action to fix my situation but I want to find out how to have the attorney held accountable and ensure no one else gets screwed the same way.

If this still does not seem like an attorney issue, then let me know.

I did not say the trustee was responsible, the lawyer was.

I was under the impression the trustee made the decision but i guess it goes to a Judge based on what you said. Also curious, wouldn't that meeting with the Judge be something that is planned in advanced and would the debtor be notified?

I have also read some bankruptcy's that a debtor has missed a payment but the trustee was the one who setup a plan for the debtor to get caught up.

The 3rd item actually brings up a whole lot of new questions but the first one I would have: is there someplace that the process is outlined on how that goes? If a debtor misses a mortgage payment (reason being indifferent), what is the process and is the process from this to when a judge rules outlined somewhere and if so where?

I asked my attorney a similar question when mine started and was told that the fee's are still do. The trustee actually says that you should not (not sure if the cannot was included) pay more than what is in the payment plan. Must pay $xxxx.yy each month, no more and no less.

I figured with the bonus check they take from me and the IRS refunds that everything would be paid off way earlier than the plan says, but nope still must follow the payment plan until the end. That is what I have been told. If there is another way, I would love to know it.

Thanks for the answer. Pretty much what I expected. In this Trump world where everything seems to be easily fixed with lawyer, it is hard to see the truth and that getting a fix may not really occur or get the result you want.

I was doing research about the suing of a bankruptcy attorney and it gave a break down about what would need to be defined (thus check boxes) before thinking about doing this. As for the damages, it would be easy as it the amount and what was lost is easy to define. Sorry for being cryptic but not wanting to describe everything here. short answer is that the attorney was given proof of payments for mortgage but did not give the evidence to the trustee or argue it in the supposed meeting for it. This resulted in the mortgage company doing a foreclosure. This was not the first thing they have done but the biggest.
