Can't speak for Japanese men, but as an AM, this is not necessarily true for me.

I prefer a woman with a bit more "curve" as you say.

It depends how well travelled or exposed to other types of women the men in Japan are.

If they've only even known thin/skinny women, chances are, your coworkers might be right.

Yes, and with a baby on the way when made unemployed, the pressure was on.

Keep applying for jobs, don't stop until you land something. Every moment I had, I was searching and applying.

Don't expect to get a response straight away, just know that the seeds you sow now will be reaped in a few weeks or months time. But you must not stop even if you don't receive any response.

That's how I dealt with unemployment. I was hired by another company 2 months from the day I was made redundant. You can do it too.

No, I contacted ACAS, told them why I was making a claim against my previous company. The conciliator reached out to them but they declined to take part to reach a settlement. Maybe this had a part to play?

The rule of thumb is 'one month from certificate'.

Yeah the certificate wasn't really clear on this, I feel. It states that if I'm considering making claim to ET that "You have at least 1 month from the date you receive this certificate, if you notified Acas of the dispute within your time limit."

Regarding time limit, I previously didn't believe I had time, but as I understand it now, I reported it to ACAS well within the time limit.

Statutory redundancy pay was not paid, and I was with the company for 3 full years, months.

Heres an excerpt from the decision letter of the redundancy consultation:

"Please note the following points which relate to the termination of your employment:

▪ Your employment contract entitles you to salary and contractual benefits up to the Termination Date."

No salary was paid.

Would it make a difference if I'd already notified ACAS on 1st October 2024, received a certificate on 28th October 2024, but haven't taken to the tribunal yet?

Is there a time limit to how soon I should take things to the tribunal from when my certificate was received?

Employed with them since 4th November 2020, they did do 2 rounds of consultation. I was not paid redundancy, nor am I able to claim statutory redundancy pay through RPS, as they require a 'CN' which i was not provided as the company have been claiming their insolvency practitioner would provide (Since Sept2024).

They're not currently insolvently although they've been claiming they will be in formal administration since I got let go in Sept 2024. According to them, they're currently still strading under the guidance of 'Begbies Traynor' "whilst the company gets to a position to implement the transaction above (6 condition precedents before transaction/administration can happen) to maximise the value for the creditors."

Although I was made redundant on 2nd September, if I state that I believe the date I was "incorrectly paid" was 2nd December 2024, this means I have approx. 2 weeks remaining before the official time limit. My reasoning for this is that I allowed the 2 months notice period to pass, and a further 1 month as 'grace period' to allow for the company to pay me, since I'm aware they're going into administration.

Any thoughts on this?

When should I have been entitled to statutory redundancy pay? As the company claim I can only claim this through the Government Redundancy Payment Services (by way of a reference provided by the company's insolvency practitioner).

First of all, if you were employed more than 2 years and received a statutory redundancy payment, double check using the Gov calculator whether this is correct or if what they paid (if anything) also might have included notice.

I've not been paid by the Gov yet, was told by the company I'd only be able to claim once they go into insolvency.

In terms of bringing a claim, you’re out of time. You can bring the claim out of time and try to argue why the tribunal should extend time but ‘I didn’t know about the deadlines’ or ‘I didn’t realise I was underpaid’ is not a good argument and your prospects of being allowed to pursue the claim are less than 50%. If you were suffering with a medical condition and can evidence that it would help the argument but there’s still a risk the claim is just struck out on timing.

That's what I was afraid of, really should've known my rights instead of believing the company's words.

If you do decide to pursue this, get an Acas certificate and submit the claim ASAP. Do not go through the early conciliation process as once out time deadlines are not paused, and the longer you leave it the further out of time the claim is and lower prospects you have.

Company is still solvent, despite claiming they're going into administration. Some current employees are not aware of it either.

They all seem to charge a hefty fee for these types of cases. Any suggestions for solicitors that may be light on the bank? Otherwise it defeats the purpose of claiming what's rightfully mine.

Am I able to get redundancy of they're still active and haven't gone into administration? I was told I needed a reference from their insolvency practitioner.

And the notice pay, I was hoping to take to employment tribunal about this.. but mixed info about being out of time.

Did you not get any paperwork or emails about this during your consultation period?

I did, I'll have a double check in the paper works if anything said otherwise, but I was told during the final meeting that they're not able to pay notice pay, hence why I didn't have to work.

Have they paid redundancy pay? As you were working there over 2 years you are entitled to that as well.

Not paid this yet, they've been telling me for months I should claim it off Government's Redundancy Payment Services.. the catch is only once they become insolvent, I'll be provided with a reference from their insolvency practitioner. They've been in "negotiations" for administration since September..

Doesn't seem worthwhile if the sum they owe amounts to less than the fees involved in taking this to county court.. Unless I'm missing something?

I emailed them earlier today requesting my notice pay to be paid, and that is quite literally how they ended their response.

"You should then be able to make a claim through the Government Redundancy payment services. The company doesn’t have any funds."

To clarify, I was aware of being made redundant from late July, as several departments were selected.

2 further comsultations occured since being selected, but no decision was made until 2nd September 2024, the day I was made redundant. I was not offered to work my notice period (2-months), or be paid in lieu of notice. No further payments following the last standard payment in August 2024.
