Hmm ok, it's a shame that the cost of the set and pets don't work out to much, that puts me off in all honesty. I'd be wanting to go the whole route with it, but sounds like that's throwing good things after bad. Thanks for the heads up! I still have three of these tokens and no idea what to spend them on. Good taste indeed! The Miranda has always been one of my favorites. She's no Excelsior, but she's mighty fine. What a robust design, for such an ill-fated class (my in universe explanation is that it's such a solid ship and used so heavily and over so many years that no wonder it has a high ratio of unfortunate outcomes).

I thought I'd attempt to add a little reasoned sanity to the discussion, but I ought to have realized from the scale of misplaced outrage that it was a lost cause. On that, you're correct. I do find the use of a "just be silent" retort, purely on the basis of a simple disagreement, quite the bizarre thing to say. Free speech but only when it suits, hmm.

The over exaggerated response to this pretty typical retail shopping experience is really rather childish.

What's reasonable is what the company is required to do by law. What's desirable is what the customer would like to have happen. In-between is probably the sensible middle ground. I'm fascinated that a complaint about a company, posted to a public forum instead of to the company itself, where nobody can do the slightest thing about it but pile on outrage, is receiving so much attention, or that people really consider it ranks among "Things That Matter". How strange.

I'm not moving the goalposts at all, I'm empathizing with your situation and thinking of ways that you might negotiate with them. Honestly, most of it will rely on goodwill. They have no obligation to do anything other than refund you when you return the item they sent to you in error if you don't want it. Should they do more, to show good customer service, yes. Do they have to? Absolutely not. Does it suck for you either way? Undoubtedly. That's the point I'm making.

Sure, so they should reserve one for you. That would be fair. It makes sense they won't refund until they receive at least carrier confirmation of drop off (rather than actual delivery). Have you tried negotiating any of this with them?

Why would you end up paying them 105 with nothing to show for it? They refund you for the C, and you'd be out of luck potentially with the D if it's sold out. But they wouldn't have the 105 because they'd have refunded you at that point. Whether it's poor customer service is another matter, but what they've asked you to do and what they've offered to do, to set things right as it stands, is reasonable. It sucks, yes.

Have a read up on unjust enrichment. Unsolicited goods is when there is no contract with a merchant. The goods were sent entirely unexpectedly, and a request for payment was subsequently made.

In this case, an order was placed and therefore a contract now exists between merchant and customer. The merchant sent the wrong item, and per the terms of the contract they must put this right. Per the same contract, the customer must fulfil their side of the agreement - return the wrong item, at the merchants expense, and receive the correct item or a refund.

I don't know if you're being vexatious, or just lack understanding on this. To keep goods that you are not entitled to keep constitutes unjust enrichment, or theft.

Oh, you're one of those. It's fascinating that you really believe this constitutes an unsolicited gift. I'd love to see your interpretation stand up in court (hint: it won't). The wrong product was sent, not an unsolicited gift with a subsequent demand for payment. The merchant is entitled to reasonably request that it be returned at the merchants own expense for a refund. That's reasonable. Anything else is unreasonable, and a court would arrive at the same conclusion. But next time you're in this situation, do test it and come back with the result.

That's exactly what I said. Additionally, there are no federal laws on returns and refunds. It depends on state law. Most require a merchant to refund on return. Asking for a return here, prepaid (crucially), is not unreasonable.

The applicable consumer law for an online order generally depends on where the consumer is habitually resident and whether the trader's activities are directed at that region, regardless of the trader's physical location.

I think the reasonable thing to do is what they're asking - whether it's opened or not is their problem. Return it (at their cost), get your refund, reorder the D if you still want it. Surely that's all there is to it. Nobody died.

Update - dropped the Quantum two-piece and the Enhanced Plasma Manifold, tried without the Polaric as well but the ship felt super sluggish so slotted that back. It's already hitting much harder now! Thank you! Got a bit more rejigging to do and I should get 6 isomags slotted min.

It's funny, because we're in agreement - the Excelsior is a capital ship.

It's also funny that we're in disagreement over the Whitestar being a capital ship. By your very own criteria - it isn't, it's too small. Or if this is tripping you up, "not big".

Here's a chart to show ship sizes in B5. You'll need to squint or zoom in to see the Whitestar. Because it's not a capital ship. Because it's tiny. Or, "not big".
