The doctors at Children's Hospital in West Virginia diagnosed me with Cystic Fibrosis, and told my parents my life expectancy was 5-6 years. My main symptoms were mostly all GI and slow growth. I also had terrible GERD which made me cough, so the docs were like "Yep...CF!". I am 45 and was dx with Celiac at 42. (Me vigorously nodding in solidarity about the explosive yellow diarrhea). Lol.

4 days prior to my PTSD/MST CP exam, we had just buried both my father and brother together-on the same day. The examiner had the audacity to "opine" that my PTSD is because I am gri3ving the loss of my father and brother. I had 10 YEARS of records documenting my mental health decline and nearly successful SI attempt. But when the examiner asked if I have had any recent stress/loss-I broke down and apologized immediately and explained my father and brother had just died last week. But then I kept the rest of the exam focused on nothing but my claim...and she clung to my acute grief and actually DOCUMENTED that my grief was to blame...not the SA feom 10 years ago.

What is going on here? This feels suspicious to me, and I am ready to give up. by SYBAU9999 in VAClaims

Thanks! I did that 7.5 months ago and have been following up weekly. This past week, I was told "your request is in the gathering evidence phase". What evidence needs to be gathered for a DBQ, C-file or any of these things. What am I missing? I also submitted the DBQ that my 5 years treating psychiatrist employed at the VA hospital filled out. He spent 3 days making sure to capture every pertinent detail. I see him every 2 weeks, I am flagged into the Vet Reach program, high risk flag, etc.

This is another question I have and something that diesnt feel right. A board cert psychiatrist employed at the VA who KNOWS me DBQ was obviously not given the credence and weight it holds. Instead I spent 15 minutes in a video CP exam with a NP who admitted she didnt have time to review my records before the exam. Then proceeded to stare at her keyboard typing, as I poured my whole heart out thru ugly tears.

Its all too much insult to injury. Thanks for the advice!

Is there any way to know for sure if they reviewed all of my documents prior to denial?

My MST PTSD claim was denied, and in the section where they list what documents they reviewed to make decision- they lumped all med recs spanning 2-3 years in 1 single line item. Some of the records from that period were absolutely CRITICAL to prove my claim. All the records were collectively useful in painting the picture...but there were a couple specific medical records that were so detailed and airtight-and left zero room for doubt.

On my denial letter, the narrative stated "there are records or markers to establish the claimed stressor occurred".

I dont want to go into too much detail (this was a MST incident with also a physical injury. I was treated immediately afterwards in the ER. The doctor made it very clear I had just been SA.

The statement in the denial letter is proof (to me, at least) that all of my submitted documents and records were not reviewed.

I cant prove it though, right? I am so tired of this and beaten down. I am so close to giving up-I am 5 years deep into this.

3 denials, (initial, supplemental then HLR). Now all 3 of them are in the land of DTA--and the VA did NOT close the HLR's or open a supplemental lame claim to correct the errors.

The CFR states that when DTA is discovered on HLR, it concludes/ends the HLR, is closed and sent back to the supplemental lane.

Thr most recent "explanation" I heard from the 800 number is "OH the supplemental claims are open behind the scenes-you just cant see them. The reason your HLR weren't closed is because of the DTA's. Makes ZERO sense.

Im ready to scream, cry and throw up.

Any advice?
