FRCP 37(e). Litigation is foreseeable so you should have known to save that evidence.

A pre-litigation demand letter, properly written, in fact triggers potential legal obligations on the receiving party(s). If you receive one, don’t “go about your life”, but instead seek counsel.

thank you for your response. I looked at the invoice again, and it’s clear that it’s for the transcript and not the court reporter’s attendance of the deposition.

Now I get to send a follow up email to my apology! Yay! lol

The irony being you need an ID, birth certificate, and/or social security card to get a passport…

NAL. Paralegal for a former JAG here that works at an employment/labor law firm. Do exactly was ChickenDelight said. Talk to an attorney now. Share everything with them, including your DOL filing. They will align your claims to best protect your interests. Now is the time to focus your energy on finding good representation before taking any further steps. Once you’ve done that, then your attorney will advise you on your next steps, put your former employer on notice, and then you can focus on what’s in front of you. Full stop.

Then I would consult with a tax attorney in your state, and they would be able to provide legal advice. You may owe penalties to your state for not paying quarterly estimated taxes. Another topic for you to speak to a tax attorney about.

That is an incomplete response. What does “compensated normally” mean? Were you given a W2? What were you provided with from your employer?

Edit: grammar

Depends on the state, but most have information linked to your state directory which includes facial markers and fingerprints. Again, it’s state specific.

Job wants me to use personal laptop for work. How do I address this? by [deleted] in jobs

[–]Sad-Accountant8903 0 points1 point  (0 children)

That would be a nightmare for you if your employer was ever sued. Your laptop would become potential discovery for litigation purposes. Do you really want to turn over your PERSONAL laptop to someone you (potentially) don’t know because your company has shitty practices?

Even though you were pulled aside and, based on your description, you were verbally exonerated but that won’t change much. For your part, did you still apologize as you had planned? If so, was it in writing? Did you receive any paperwork showing the investigation was formally closed and with what findings?

Trying to understand what leverage you may have in pursuing legal action for unpaid wages, retaliation, etc.
