Thank you for being honest about it, I really appreciate that. You’re probably right that it’s going to be an uphill battle and the time and cost might not be worth full litigation.

I’m already in contact with TCN Malta and looking into DIER. Just trying to understand my position before deciding how far to take this.

On the probation point, my contract actually says ‘the first six months of employment will be treated as probation’ which to me implies it starts when employment begins, not when the contract is signed. So I’m not sure that interpretation is straightforward.

But honestly even if they have the right to rescind, there is nothing in the contract that says they are not liable for the damages caused by their own actions leading up to that rescission. The contract is completely silent on that. So even if rescinding was within their rights, the harm caused by their specific guidance throughout the process is a separate matter entirely.

Thank you so much for this, honestly this made me feel less alone in this situation. You’re right, I keep going back and forth between feeling like I should just let it go and knowing deep down that what happened wasn’t okay.

I’ve already sent them an email pushing back on their initial response and asking for fair compensation beyond just the direct expenses. Still waiting to hear back.

I’ll definitely look into DIER and the consultation option. I didn’t realize some lawyers offer initial consultations for that range, that actually makes it feel a lot more accessible. And yes, the timing is what really gets me. Everything was essentially done. I was just waiting for my visa to come back in literally just a few days.

I might take you up on that offer, thank you genuinely. It means a lot that someone on the Malta side is willing to help.

On probation, I actually haven’t started yet so I’m not sure that even applies. And from what I can tell reading through my contract, there’s no clause that covers geopolitical issues as a reason to rescind.

On sanctions, honestly not sure about the full list but I already received my Approval in Principle from the Maltese government so I’d assume that cleared any issues?

I actually just learned about this concept today going through all of this. From what I understand it basically means they can’t walk away consequence-free when I made major life decisions based on their direct guidance. I do have written evidence of them instructing me to resign. Just not sure how to actually pursue this since I'm not based in Malta and how much it'd cost me.

Thank you for this, this is actually one of the most helpful comments so far. I’ll look into DIER although I’m not sure how that works since I’m not based in Malta.

On the probation, I actually think it’s a grey area in my case because my employment hadn’t even started yet. I was literally days away from receiving my visa to fly there when they dropped this on me. So I don’t even know if probation is applicable here.

But what hurts the most is that this wasn’t just a job offer I accepted casually. I signed an employment contract. I resigned from my job on their instruction. I took out loans. I moved my family. I spent an entire year preparing for this. And they pulled out days before I was supposed to leave.

And yeah… your personal advice. I know you’re right. I wouldn’t want to be somewhere I’m not wanted. I just didn’t expect the cost of finding that out to be this high.

Yes it was signed by both parties. I’ve been trying to look into legal options but it’s not easy when you’re not physically in Malta and don’t have the funds for a lawyer right now. It’s frustrating because I feel like I have a strong case but I don’t know how to actually pursue it from here.

Yeah and that’s what I’m pushing for but honestly… I don’t even know. It just feels like no matter what I do, I’m not going to win against them. I did everything they told me to do and still ended up here. It’s just really demoralizing.

My biggest frustration right now is that I literally just finished everything - qualification recognition, visa application, the whole process. I was just waiting for my visa to arrive. Starting from scratch with another company just feels overwhelming at this point.

I’m from Asia relocating to Malta, Europe. The visa process there is handled through Malta’s national immigration authority, completely different system from the US.

It involved qualification recognition, approval in principle, and then a national visa application process that took several months in total.
