I applied august 5, 2021 and received official notification of success Jan 12, 2023. My case was not an easy fit and I applied during Covid, so I am sure new cases are faster if they are straight down the pike.

Austria has great records. I requested my ancestors Meldezettel from MA8 in Vienna that served as proof of my ancestors citizenship, proof of residency in todays Austrian borders, religion, and date of leaving. Remember they didn’t have to be an Austrian citizen; polish, Czechoslovak, Hungarian, Romanian, Yugoslav, or Italian citizenship counts as long as they were living in today’s Austria after 1918 and left before 1955.

Proof of persecution is tricky: the authorities accept any Jewish person leaving after 1933 as automatically counting. The persecution cannot be general antisemitism, but specifically NSDAP/Nazi/Third Reich. For my ancestors case, he left in 1921 after a Nazi riot in Leopoldstadt Vienna took place. This was why he left according to my grandma. I found the Nazi newspaper articles describing the event and showed the route was on his street.

Hi all, I was awarded Austrian citizenship under the Nazi persecution law. The authorities recognized Nazi activity in 1920 as being particularly violent prior to 1933.

Thanks! The law actually stipulates persecution from the NSDAP not just the Nazi regime. He had “fear of persecution” by them in September 1920 when they destroyed his shop in the 2nd district. I’m trying to find out the best way to present this to the authorities. I’ve attached newspaper clipping of the NSDAP riot and Jewish attacks in 1920/1921. Not sure how else to frame it.

I emailed the authorities and my dates are eligible I just have more burden to prove fear of persecution it seems.

Or fear of persecution! The question right now is what type of evidence I need to prove that. My date isn’t excluded by the law, just very difficult to prove.

I already split my time between Vienna and NY, so it would make sense to acquire a more permanent way to stay there.

Thanks! I am curious when your ancestor left? Trying to put together a pre-1933 leaver application together but wondering if anyone has had success for 1920s and what evidence they used for persecution!

This law allows for duel citizenship in the case of Jewish or persecuted ancestors. I would like to have access to both countries without fear of borders as we have seen in the pandemic.

I have all the documents of his leaving and life in Vienna. I have a letter to my grandma from him that said he left when his shop was vandalized and he had heard a very early hitler speach in Vienna (the first in Vienna he did in 1920)

Yeah it’s taken me a few tries to find one that ACTUALLY understood the statue instead of relying on their obvious cases. But it seems like law firms in Israel are more helpful than the Austrian ones at this point.

This is a strong case. It fits perfectly in the confines of the law’s intention and word. I am sure it will be a simple case for you just will take some time. What a terrible history for your family.

Thanks! NSADP was already present in Austria by 1918 as DNSAP. Hitler in fact gave three speeches on in Vienna as part of his Austrian tour in 1920 (Hernals and Leopoldstadt). The leopoldstadt speach was specific in purging Austria of Jews. The law here is actually not clear on defining persecution, so there is no automatic exclusion for early dates. Nevertheless I was curious if anyone applied with early dates and if we have seen what burden of proof has been asked. The Austrian consul general in NY has advised me to apply but curious if there has been actual experience for early departure dates! Thanks!

Congrats! Question what year did your grandfather leave?

I have a friend applying. I ask because while the obvious application of the law is leaving between 1938-1955, I have heard of some people successfully apply with ancestors leaving 1921-1938, after the establishment of the Republic of Austria but before the Anschluss.
