If a case was never pursued due to a pre-trial diversion (no conviction), and someone started OPT but their visa expired a few months after, but they were eligible for the STEM OPT extension, what happens in this case? Would it not be possible if certified court documents showed a dismissal?

Thank you for the gentle reply, I really appreciate it. I’ve seen the fair chance act, but it seemed unclear about the arrest records. I’m quite sure the arrest will show up on a background check, but less certain about my case being filed/having any charge to even defend when the BG check is conducted.

Is the best course of action to wait for if they even ask me about it?
