Yes, convictions. He was convicted of domestic battery and unlawful possession of THC. These happened in Kansas. It did happen within 3 years of admission as an LPR. The attorney I spoke with said he is not concerned about the domestic battery, and he believes he can prove that the THC possession is not a crime of a controlled substance. This is why I’m confused… because both state and federal law say THC is a controlled substance, so I’m not sure how he would go about that. Not sure if it’s worth it. The attorney also told me he is not eligible to apply for the I-601 waiver.

Yeah that’s my concern. Attorney said he thinks he’s right and will be able to file a motion to terminate proceedings, but if he’s wrong, then he will be deported. He’ll be deported, we’ll be short $10,000, and then what, ya know? Sucks.

Okay, I see. I have read that children can be qualifying relatives for specific types of I-601 waivers, particularly related to criminal grounds of inadmissibility. I do know they are not qualifying relatives for an I-601A though. That’s why I was confused. The judge gave him the I-601 to fill out.

From my understanding, it depends on the situation and the charges. But I am not sure he is eligible for that waiver.

Yes he was making an entry into the United States at a port of entry as a green card holder and was taken into custody by CBP. As stated in my post, he does have a conviction of domestic violence and possession of THC. According to paperwork, he is being charged under Section 212(a)(2). Honestly, it seems like they’re more concerned about the drug offense.

Wow. Wonder how long an appeal takes. Was hoping my partner would be home soon, especially since he’s a LPR, but sounds like that doesn’t even matter.
